As Mr Muniandy admitted the breach we found the charge proved.

Facts:
Following the running of Race 8 (GAVELHOUSE.COM New Zealand 1000 Guineas Group1), an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that S Muniandy (THE SPARKLE) permitted his mount to shift inwards near the 1300m dictating MAHIDUN (T MOSELEY) inwards causing THE LUSTRE (J Lowry) to check and DIJON BLEU (L Innes) to steady.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Muniandy confirmed to the Committee that he understood the charge and he admitted the breach.
Mr Oatham had Mr McLaughlin demonstrate the incident using the available camera angles. He used the head-on view to show where Mr Muniandy (THE SPARKLE) shifted inwards from a wide barrier draw when not clear of Mr Moseley’s mount. As a result of coming across in the manner he did MAHIDUN was dictated inwards, which in turn caused interference to THE LUSTRE and DIJON BLEU. The side-on view showed, that at no stage was Mr Muniandy clear of Mr Moseley when he came across. Mr Moseley was forced inwards resulting in a check to Mr Lowry and causing Mr Innes to steady his mount, DIJON BLEU.
In response to a question from the Committee Mr McLaughlin said there may have been some contact between Mr Muniandy and Mr Moseley’s mounts.
Mr Muniandy admitted moving inwards but said, prior to making any contact, Mr Moseley’s mount was already moving inwards. He said MAHIDUN was wearing blinkers for the first time at the races and in his opinion, that horse overreacted.

Mr Oatham produced Mr Muniandy’s record which showed two careless riding charges over the last 12 months:

Mr Oatham confirmed that Mr Moseley’s mount (MAHIDUN) was racing “quite hard” and didn’t help the situation but he said Mr Muniandy moved inwards over quite a distance. The Stewards’ opinion was that his degree of carelessness was in the midrange. In relation to the interference caused, Mr Oatham said there were low-level consequences to the runners affected.
An aggravating factor was that today’s breach occurred in a significant race worth $300,000 and one of the few Group 1 opportunities for fillies in the racing season.
Mr Oatham submitted that a suspension in the vicinity of 10 national riding days would be an appropriate penalty.
Mr Muniandy told the Committee that he rode only in the South Island and that he has trouble keeping his weight down when he is not riding. He advised that any suspension could begin immediately as he did not have any firm commitments to ride within the next seven days.

The Committee began with making an assessment of Mr Muniandy’s overall degree of carelessness. The head-on film showed where Mr Muniandy came across when not clear, dictating Mr Moseley inwards over quite some distance, before eventually making contact with Mr Moseley’s mount. We heard evidence that Mr Moseley’s mount was over-racing however it was our opinion that Mr Muniandy should have straightened a lot earlier than he did, but failed to do so. If he had not dictated the line of Mr Moseley the interference would not have happened. The Stewards described the consequences of the incident as low-level however two horses were affected at a stage of the race where positions can be crucial. We placed Mr Muniandy’s degree of carelessness above midrange.
The Committee adopted a starting point of nine national riding days. The Group 1 status of the race and the stake of $300,000 were significant aggravating factors for which we applied an uplift of three days.
Mitigating factors were Mr Muniandy’s good record and his admission of the breach for which we allowed a one-day discount.
