DECISION AND REASONS:
--Mr & Mrs Parsons, Licensed Trainers, were charged with a breach of Rule 828 (1) & (2) alleging that, as the trainers of the horses PINS?N?NEEDLES (Race 3), NOI (Race 5) and QUERELLA (Race 8), they failed to scratch those horses by the prescribed time of 7.30am on raceday.
----Mr J F Parsons was present at the hearing of the information and admitted the breach. The charge was accordingly found to be proved.
----Mr Ching said Mr Parsons had approached the Stipendiary Stewards prior to Race 1 saying he understood that three of his horses had been scratched prior to 7.30am. When enquiries were made of the National Racing Bureau, it was established that Mrs Parsons had made contact but, on both occasions, only to query the track and not to scratch the horses. All three horses were then late scratched at 12.51pm. The Stewards were particularly concerned that a horse in Race 8 had been denied a start due to the failure to scratch on time. Mr Ching recommended a fine of $400-600.
----Mr Parsons stated that he had taken some horses to the beach at about 7.20am. Prior to his doing so, Mrs Parsons had phoned the Bureau to get the track conditions and, on learning of the penetrometer reading of 3.1, Mr Parsons decided to scratch three of the nine horses that he had running. When he arrived at the track, he learned that the horses had not been scratched. Mrs Parsons had overlooked scratching the horses, he said.
----Following a deliberation, the Committee delivered the following decision in relation to penalty:
--"The Committee has listened to the submissions of Mr Ching and Mr Parsons in this matter. In determining penalty, the Committee has had regard to the following matters:
------1. Mr Parsons' frank admission of the breach which, really, we find is the only mitigating factor in this particular case.
--2. By way of aggravating factors, we have taken into account the following matters:

- The information relates to the late scratching of three horses from today's meeting; ----
- The notification of the scratchings was made at 12.51pm and this, clearly, would have had a consequential effect on the betting public who will have invested on the three horses on the win and place and in multiples betting. We also note that the late-scratched horses were involved in races of the Pick 6 jackpot on today's meeting; and ----
- The Committee's concern that, in the case of the late scratching of QUERELLA in Race 8, another horse was denied the opportunity of a start in a $35,000 race on New Zealand Cup day. --

So, taking all matters into account, the Committee is of the view that this breach is a serious breach of the late-scratching Rule and we have fixed the amount of fine accordingly. Mr & Mrs Parsons are fined the sum of $550.00."
