Evidence:
Following the running of Race 3, the Speights’s Mid Ale Open Handicap 1200, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class A Rider, Mrs L Allpress, alleging careless riding in that she “… permitted her mount, WIZE ACT, to shift outwards when not clear of DYNAMIC (S Weatherley) near the 200m.”
Rule 638(1)(d) reads as follows;
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mrs Allpress, acknowledged that she understood the Rule and confirmed her admission of the breach.
Mr Davidson, had Mr McLaughlin demonstrate the incident by video using the front and side on views. He identified Mrs Allpress and her mount WIZE ACT. He identified where Mrs Allpress moved her mount out prior to the 200-metre mark checking DYNAMIC, Mr Weatherley.
Mrs Allpress said having viewed the videos that it was self-explanatory. “Maybe I should have waited another stride and maybe could have gone between those two … I felt my only option was to come outside that horse but didn’t realise that I wasn’t clear”.
Decision:
As Mrs Allpress had admitted the breach the committee found the charge proved.
Submissions for Penalty:
Mr Davidson said that Mrs Allpress had a very good record especially for the number of rides she has had. Her only breach in the penalty record showed a 4 National riding day suspension on 24 March 2018 at Riccarton. Mr Davidson stated that the Stewards considered this breach to be in the low – mid level range of carelessness. He further emphasised Mrs Allpress’ excellent record. He said the JCA Penalty Guide provided a starting point of a 7 – 8 National day suspension for a low range breach and submitted that he would leave it up to the Committee to decide the length of that suspension.
Deferment was discussed with Mrs Allpress but she declined, stating that she did not wish to do so.
Reasons for Penalty:
The JCA Penalty Guide starting point for careless riding (in the low-medium range of culpability) is a 7 - 8-day suspension for a second breach of the rule. The Committee agreed with the Stewards that this was a low-medium range breach so therefore adopted the 7-day starting point. Apart from only one incident in March 2018, the committee accepted the Stewards view that Mrs Allpress is a very busy and competent rider. Accordingly, the Committee determined there were no aggravating factors of the breach or personal to Mrs Allpress.
The mitigating factor was Mrs Allpress’ admission of the breach and we were able to afford her a 1-day reduction in penalty.
As riders were declared for the meetings at Te Rapa/Hastings 19 May and Riverton on 20 May the penalty imposed would commence after racing on 21 May.
Penalty:
Accordingly, Mrs Allpress had her licence to ride in races suspended for a period to commence after racing on Monday 21 May 2018, up to and including Wednesday 30 May 2018.
