As the result of an incident shortly after the start of Race 9, the Christchurch Casino Easter Cup Stakes, Ms Danielle Johnson, was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing (careless riding).

Ms Johnson pleaded guilty to the charge, which is therefore deemed to be proved.

The Stipendiary Stewards showed to us the incident from two separate video cameras.  Ms Johnson was barrier draw number 11 in a 12 horse field.

After about 100 metres or so, Ms Johnson began an inward movement allowing her mount to shift inwards when not sufficiently clear, dictating “Eel Win” inwards on to “Our Genes” and “Just Us”, and then further, in a second movement, dictated “Eel Win” inwards again, crowding “Don’t Say Clang”.  This all occurred near the 1500 metre mark.

The incident took place over a distance of about 100 metres and it was quite clear in that time that Ms Johnson was not the requisite horse length and another length clear, as she made her inward movement.

A considerable number of horses were inconvenienced in the process.

PENALTY DECISION

--

This was a bad piece of riding on the part of Ms Johnson.  I am grateful to her for having acknowledged her guilt at a very early stage, without reservation.  That is appreciated by this Committee.

It was, as Mr Ching correctly observed, at the higher range of carelessness.  Ms Johnson’s movement across the field was a continuous movement, and not at any stage, was she safely clear of the other horses that there affected. 

--

All riders know, at this stage of the race, that particular care needs to be taken as all riders are looking to position their horses to accord with riding instructions, and it is also at a stage where horses are full of running.

--

A suspension must follow, and that suspension has to be cumulative on that that we imposed on Ms Johnson earlier today. 

--

Mr Ching called for a suspension of between 8 and 12 days.  We are, as we said earlier, obliged also to take into account Rule 1122(2) of the Rules of Racing.  This was a Grade III race with a $70,000 stake.  However, we are cogniscent of the fact that Ms Johnson has, until today, a pretty good record, and we recognise that.

We want to endeavour to be as fair as we can to Ms Johnson, but at the same time, we must also be fair to the other riders in the race, and we cannot overlook that.  All riders have a duty to observe good skills and they also have the right to not receive interference in the manner that she subjected them to.

PENALTY DECISION

Mr Ching called for a suspension of between 8 and 12 days.  Ms Johnson has already today been given a six day suspension.  We are going to add to her woes by imposing a suspension of 9 days, and that will come into effect at the conclusion of racing on Wednesday 29 April and will finish at the conclusion of racing on Sunday 10 May.

Mr Ching also called for a fine of between $1,500 and $3,000.  We note that Ms Johnson is an apprentice.  That being the case, and having regard to the fact that she has also been fined earlier today the sum of $500, we are not going to accord completely with Mr Ching's request, and we are going to set the fine at $1,000.

Addendum:

On Sunday 19 April 2009, I received a telephone call from Mr Ching advising that Ms Johnson has made a late application for a deferment of the commencement of the period of suspension, as he had been advised by Mr Reid Sanders, Chief Stipendiary Steward, that Ms Johnson was in fact committed to rides on Wednesday 22 April at Matamata.  I acceded to that request on the understanding that Ms Johnson’s period of suspension would now finish at the conclusion of racing on Wednesday 13 May 2009.
