As the result of an incident in Race 2 at the Canterbury Jockey Club’s meeting on 18th April 2009, Licensed Jockey S McCann, was charged with a breach of Rule 871(1)(d) of the Rules of Racing (careless riding).

It was alleged that he allowed his mount “Chief White Cloud” to shift inwards when not sufficiently clear of “Auntie Ballina” (J Misbah) causing that runner to check near the 250 metre mark.

Mr McCann admitted the breach of the Rule and the charge is, therefore, deemed to be proved.

Mr Davidson showed the Committee the incident which gave rise to the charge.  It showed Mr McCann to angle his mount “Chief White Cloud” into the racing line of “Auntie Ballina”.  That horse’s rider, Mr J Misbah, had to take hold of his horse to avoid coming on to the heels of “Chief White Cloud”.

In explanation, Mr McCann said that when he first came out onto the course proper, he intended to go to the centre of the track.  He then changed his mind and went back over to take up an inside running, but was unaware when he did so, that Mr Misbah had come into the gap.  He found that he was then in a tight spot.  When he heard a call from Mr Misbah, he was already on the heels of another horse and having regard to the fact that his horse was a large horse (18 hands) he said that it was going to take him some time for him to check out of the situation.

With regard to the question of penalty, Mr Ching said that Mr McCann had not been charged pursuant to this Rule in the past 12 months, although he observed that he has not had a lot of rides of recent times.  In fact, Mr McCann confirmed that he had only had three rides since March.

Mr Ching considered that it was a misjudgement on Mr McCann’s part, but that the carelessness was mid-range.  He recommended a suspension of somewhere between four and six days.

Mr McCann had no submissions to make on penalty.

PENALTY DECISION

--

In considering penalty, we must discount Mr McCann’s submission that he did not realise that Mr Misbah had moved on to the line that he had just moved off.  At this stage of the race, the field is normally starting to bunch up, and in such a situation there remains with any rider, the fundamental duty of ensuring that he is his own length and another horse length clear before moving across.

Mr McCann did not do this, and had it not been for some skilful riding on Mr Misbah’s part, there could easily have been a fall.

We agree that the degree of carelessness was mid-range, and in determining penalty we have given Mr McCann credit for his early guilty plea and his good record.  A suspension is appropriate, which we set at four days.

Mr McCann indicated to the hearing that he does not seek to exercise a deferment of penalty pursuant to the Rules of Racing.  The period of suspension, therefore, commences immediately and will expire at the conclusion of racing on Saturday 2 May 2009.  That is four days, encompassing two days at Marlborough on 23 and 26 April, Riverton on 1 May and Canterbury on 2 May 2009.
