As Mr Walters has admitted the charge, it is therefore deemed to be proved.
Penalty:
Mr Walters is suspended for a period of two days which period of suspension will come into effect at the conclusion of racing on Thursday 22nd September and end at the conclusion of racing on Monday 26th September 2011.
Charge:
It was alleged that Mr Walters permitted his mount "Catalea" to shift inwards over the concluding stages when not sufficiently clear of "Contador" causing this horse to be checked.
Facts:
With approximately 100 metres or so to the finishing post, Mr Walters riding "Catalea" was racing in the clear but wide on the track. As he rode with vigour, his mount when under a hard ride, moved across the line of "Contador" which was racing outside of "Jayar" (CW Johnson). The conseqence was that within the last 20 to 30 metres, Mr M Cameron on "Contador" was squeezed and had to be checked off the heels of "Jayar". "Contador" was deprived of its racing line and could possibly have improved into the gap that was available before the pressure came on from "Catalea".
Submissions for Decision:
Mr Walters, assisted by his employer, Mr J Bridgman of "Te Akau Stables" explained that his horse did move inwards when being hard ridden under the whip and asked the committee to take into account the fact that CW Johnson on "Jayar" did move outwards slightly and contributed to the incident. He also asked us to note that his horse was racing "greenly" earlier in the race and was not giving him an easy ride.

Mr Ray, on behalf of the Stipendiary Stewards, told the hearing that Mr Walters was most co-operative with Stipendiary Stewards at all times. Even though Mr Walters had just come back from from a suspension, he had a quite a good record. He submitted that the incident did not have any effect on "Contador's" chances of finishing in a better place. He conceded that "Jayar" did move out a fraction and may have contributed to the incident. Mr Ray submitted that a suspension of perhaps two days could be considered.
Mr Walters and Mr Bridgman did not have any further submissions to make but did make application for any period of suspension to be deferred until after the meeting on 22nd September which is now to be held at Waimate.
Reasons for Penalty:
In considering a penalty for careless riding, generally speaking, the starting point is a suspension of five days.
We note that the incident was in the last twenty to thirty metres of the race and was contributed to by CW Johnson whose mount did move in perhaps between a half and a full horse width and thereby contributed to the "squeezing" of "Contador".
Mr Walters had his mount under a hard ride in order to finish in the best possible position and he cannot be criticised for that. It was conceded by the Stipendiary Stewards that the chances of "Contador" were not affected. Mr Walters has admitted the charge at the earliest possible opportunity. They are the mitigating factors.
The only aggravating feature is the fact that Mr Cameron's safety may have been compromised to a degree by virtue of him having to check off heels.
After taking into account the mitigating features and the aggravating feature, we are going to set the period of suspension at two days. This somewhat short period of suspension is to recognise that even though Mr walters rode carelessly, it was at a stage in the race whereby there was no impact on the chances of "Contador", as well giving as much weight as we can to the mitigating features referred to above.
