At the Canterbury Jockey Club’s meeting on Saturday 15th November 2008, Licensed Jockey CW Johnson contracted with the connections to ride “Tap Again”, a starter in Race 4, at weight of 54 kgs. As Mr Johnson could not make that weight, he was charged pursuant to Rule 520(4)(c) of the Rules of Racing.

Mr Johnson admitted the breach of the Rule which is therefore deemed to be proved. Furthermore, Mr Johnson made it clear to Mr George that he did not wish to present at the hearing of the charge, and indicated that on the information.

PENALTY

With regard to the question of penalty, Mr George has recommended a fine similar to that which was imposed on Mr Johnson on a previous occasion earlier this year, namely $200. We have given consideration to this, but bearing in mind that this is a listed stakes race on a premier day, whereby connections and the betting public alike have been let down, we feel that the fine needs to reflect that, particularly having regard to the status of the race.
