Following the running of Race 10 at the Canterbury Jockey Club’s meeting on Saturday 15 November 2008 a protest was instigated by Licensed Trainer, Mr S Anderton, alleging interference by “The Meista” which was placed 1st by the judge to “Westend Lady” placed 2nd by the judge.

Following the running of Race 10 at the Canterbury Jockey Club’s meeting on Saturday 15 November 2008 a protest was instigated by Licensed Trainer, Mr S Anderton, alleging interference by “The Meista” which was placed 1st by the judge to “Westend Lady” placed 2nd by the judge.

The protest was pursuant to Rule 876(1) of the Rules of Racing.

Mr Anderton said that at the 250 metre mark that “Westend Lady” was racing about four off the fence when “The Meista” ridden by CW Johnson which was racing two off the fence, went looking for a gap between it and “Classic Pins”.  Johnson’s actions moved “Classic Pins” into contact with “Westend Lady”.  “Westend Lady’s” hind quarters pushed out when contact was made, and Mr Anderton said that she lost momentum and that it took her some time to get going again.  He said that a margin of a long neck was such that had it not been for the interference, that “Westend Lady” would have finished ahead of “The Meista”.  Mr Anderton asked his jockey, Mr Jay Misbah, to comment on the matter.  He told the hearing that a lot of pressure came from the inside and that his mount lost momentum.

Mr Williams, the defendant and the trainer of “The Meista”, asked his rider, Mr CW Johnson, to comment on the matter.  Mr Johnson said that he was looking for a run and believed that there was an adequate gap for him to take.  He said that other horses seem to lay in on him, and that “Westend Lady” then put a length on him and “Classic Pins”.  However, “The Meista” then increased pace and he said that he then finished the race a long neck ahead of “Westend Lady” and “going away”.

We asked Mr George to comment on the matter.  He believed that there was insufficient room for Mr Johnson to move through but that, in the Steward’s opinion, they could not be satisfied, having regard to the end result, that the interference cost “Westend Lady” a long neck.  “The Meista” came from well behind and beat “Westend Lady” comfortably.

We issued an interim decision dismissing the protest.  In our opinion it was difficult to tell exactly where the pressure came from.  It seemed to us that all three horses had a part in this incident.  There was some outward movement from “Classic Pins” as well as “The Meista”, but similarly, there was retaliatory inwards movement from “Westend Lady”.  We believe that Mr Johnson went into a gap that he made for himself.  However, the critical point was that notwithstanding the impact that the head on view of the incident made, when the incident was looked at from the side on views “Westend Lady” did seem to keep going.  That is to say, it is difficult to say whether or not she in fact lost any momentum.  In fact, she then went on to put a length in distance on “Classic Pins” and “The Meista”.  However, “The Meista” improved well to such an extent that it was able to beat “Westend Lady” quite comfortably and to use Mr Johnson’s expression, “The Meista” was “going away”.

Thus, having considered all of the evidence, we are not satisfied that the interference was such that it prevented “Westend Lady” from finishing ahead of “The Meista” and the protest was dismissed accordingly.
