Decision:

Following the running of Race 1 at the Canterbury Jockey Club’s meeting on Saturday 15th November 2008, a protest was lodged pursuant to Rule 876(1) of the Rules of Racing by Ms K Myers, the rider of “Beersheba Knight” which was placed 2nd by the judge.  She alleged that “The Foreman”, placed 1st by the judge caused interference by her mount over the concluding stages.



Following the running of Race 1 at the Canterbury Jockey Club’s meeting on Saturday 15th November 2008, a protest was lodged pursuant to Rule 876(1) of the Rules of Racing by Ms K Myers, the rider of “Beersheba Knight” which was placed 2nd by the judge.  She alleged that “The Foreman”, placed 1st by the judge caused interference by her mount over the concluding stages.

Present at the hearing were Ms Myers and a representative of the connections of “Beersheba Knight”.  Mr David Howarth, the trainer of “The Foreman”, was present, together with Licensed Jockey Mr L Innes, the rider of “The Foreman”.

Ms Myers alleged that in the concluding stages of the race, that there was contact between her horse and Mr Innes’s.  She said that following the contact, which she described as a “bump” that Mr Innes then continued to dictate her line.  She said that contact occurred on two occasions, and said that she could not use her whip, and believed that had it not been for the interference that her mount would have beaten “The Foreman”.

In response, Mr Innes said that his horse did roll in to a certain extent and that he and Ms Myers were racing in tight quarters, but asked the panel to observe that Ms Myers did not have to stop riding her horse with vigour, and that he did not believe that Ms Myers’ mount would have finished ahead of his.  He said that at all material times, his horse was a quarter of a length ahead and that in the concluding 20 or 30 metres, he eased his mount down and the margin between them was, at the winning post, a half a length.

Mr Howarth also commented that Ms Myers had every opportunity and had plenty of room to use the whip.

Mr Cameron George, Chief Stipendiary Steward, was asked whether or not he considered there was interference caused by “The Foreman” to “Beersheba Knight”.  He said that the “The Foreman” contacted “Beersheba Knight” momentarily, and said that the film revealed that “The Foreman” was a quarter of a length in front at most times and maintained that position to the finish.

We issued a preliminary decision, advising the parties that the protest was dismissed.

REASONS

--

In terms of Rule 876(1) of the Rules of Racing, we must be satisfied that there was interference and if so, we need to be satisfied that the horse interfered with would have finished ahead of the first mentioned horse had such interference not occurred.

We were of the opinion that there was some minor interference and perhaps there was some inward movement on the part of Mr Innes’ mount.  As to whether or not that could be said to have been dictating the line of “Beersheba Knight” is not something we are satisfied as to.

Therefore, we consider that any interference was minor, and as a consequence, we do not believe that “Beersheba Knight” would have finished ahead of “The Foreman” and therefore, the protest was dismissed accordingly.
