As Mr Campbell had admitted this breach of the Rules it was found to be proved.

Penalty:

Mr Campbell’s Class B Jockeys licence is suspended from the conclusion of racing Saturday 17 February up to and including 25 February 2018.

Facts:

Following the running of Race 8, the Christchurch Casino Rating 85, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class B Rider, Mr C Campbell, in that he permitted his mount SATIN GURU, to shift inwards when not sufficiently clear of SWEET INDULGENCE which was checked passing the 300m.

Rule 638(1)(d) provides as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Mr Campbell had indicated on the Information that this breach of the Rules was admitted, and he confirmed this at the hearing. Mr Campbell also agreed that he understood the charge and the Rule it was brought under. Mr D Walsh, NZTR Apprentice Mentor, assisted Mr Campbell at the hearing.

Mr Davidson, with the assistance of Chief Stipendiary Steward, Mr J Oatham, gave evidence and used video coverage to show that approaching the 300m SATIN GURU, ridden by Mr Campbell, was racing wide on the track and looking to improve his position. Mr Campbell observed a gap to the inside of RED RIVER ROCK, ridden by Mr Cuneen, but prior to being able to take full advantage of that position, the gap closed, causing him to check. Mr Campbell, he said, then attempted to take a gap on the inside of another runner and angled his mount inwards without being clear of SWEET INDULGENCE, ridden by Miss S Wynne, who had to check.

Mr Walsh stated that Mr Campbell should have taken a hold and assessed the situation before continuing on. He said there was not a lot more to say about the incident.

Submissions for Penalty:

Mr Davidson stated that Mr Campbell’s record showed a low range breach on 15 December 2017 at Wingatui where he received a 4 National Day suspension. He submitted that Mr Campbell’s record be treated as a neutral factor. Mr Davidson submitted that the breach was low level with some mitigation and that a 5 to 6 National day suspension be considered as penalty.

Mr Campbell elected to make no submissions on penalty.

The matter of deferment was discussed with Mr Campbell requesting that any suspension begin as soon as possible after the Invercargill meeting on 17 February where the riders were already declared.

Reasons for Penalty:

The JCA starting point for a low-level breach is a 6 National day suspension. We agreed with the Stewards that this was a low range breach and accordingly adopted the 6-day starting point. There were no aggravating factors to warrant an uplift in penalty, as we agreed with Mr Davidson that Mr Campbell’s record was a neutral factor. We also took into consideration Mr Campbell’s frank admission of the breach with which we afforded him a discount. This discount we set at 1 day. We therefore determined that a 5 National day suspension was an appropriate penalty in this case.
