As Mr Mudhoo had admitted this breach of the Rules it was found to be proved.
Penalty:
Mr Mudhoo’s Class B Jockeys licence is suspended from the conclusion of racing Saturday 17 February up to and including 7 March 2018.
Facts:
Following the running of Race 5, the Clare Yardley-Barrister Rating 75, an Information was filed by Stipendiary Steward, Mr M Davidson, against Class B Rider, Mr K Mudhoo, in that he permitted his mount FLYTIME, to shift outwards over the concluding stages when not sufficiently clear of ZAWHIP, which was checked.
Rule 638(1)(d) provides as follows:
“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless”
Mr Mudhoo had indicated on the Information that this breach of the Rules was admitted, and he confirmed this at the hearing. Mr Mudhoo also agreed that he understood the charge and the Rule it was brought under. Mr D Walsh, NZTR Apprentice Mentor, assisted Mr Mudhoo at the hearing.
Mr Davidson, with the assistance of Chief Stipendiary Steward Mr J Oatham, gave evidence and used video coverage to show that over the concluding stages Mr Mudhoo, riding FLYTIME, was racing midtrack and shifting outwards under a ride. On the outside of Mr Mudhoo was ZAWHIP, ridden by Mr C Johnson and near the 50m had to check due to Mr Mudhoo’s outward movement. This incident, Mr Oatham stated, may have affected the chances of ZAWHIP finishing in a better place.
Mr Walsh stated that there was a small contribution from the horse outside, SACRED DESIRE which he said shifted inwards slightly, when the situation was tight, which may have contributed to some extent.
Submissions for Penalty:
Mr Davidson stated that Mudhoo’s record showed 3 breaches over the previous 12 months being 16 March 2017 at Riccarton, where he received a 3 South Island-day suspension, 7 November 2017 at Wingatui where he received a 5 National-day suspension and an 8 National-day suspension at Wingatui on 26 December 2017. Mr Davidson stated that the breach was at a mid to high range and submitted that an 8 to 10-day suspension be considered in this case.
Mr Walsh stated that FLYTIME was a difficult horse to ride and has had issues in the past. He said that Mr Mudhoo did a good job getting the horse over the line to win the event.
The matter of deferment was discussed with Mr Mudhoo requesting any suspension begin as soon as possible after the Invercargill meeting on 17 February where the riders where already declared.
Reasons for Penalty:
In determining penalty, the Committee took into consideration Mr Mudhoo’s admission of the breach and the level of carelessness, which we also assessed as mid to high. We also took into account Mr Mudhoo’s penalty record which showed 3 breaches over the previous 12 months, his most recent in December, which we determined was an aggravating factor in this case. The JCA Penalty Guide provides a starting point of an 8-day suspension for a mid-range breach and a 10 day suspension for a high range breach. In this case the Committee determined that a 9-day starting point was appropriate. The aggravating factor was Mr Mudhoo’s penalty record which warranted an uplift in penalty which we set at 2 days. We were however, able to afford Mr Mudhoo a discount of 1 day for his admission of the breach. We therefore determined that a 10 National-day suspension was an appropriate penalty in this case.
