DECISION AND REASONS:

Following the running of Race 3, Anglican 2006 Celebrating 150 Years Maiden, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Apprentice Jockey, Miss C L Spittles, alleging careless riding in that Miss Spittles allowed her mount, STRIKE IT LUCKY, to shift ground outwards with approximately 100 metres to run when not sufficiently clear causing WAIMO (D R Bothamley) to check.

Miss Spittles was present at the hearing of the information, with her employer, Mr J F Parsons, and admitted the breach.

Mr M G Humphries, Assistant Stipendiary Steward, showed head-on, side-on and rear-on video replays of the final stages of the Race. He pointed out Mr Bothamley's mount being ridden hard with Miss Spittles improving from behind. He pointed out Miss Spittles take a gap that had opened. Shortly after that, she headed Mr Bothamley's mount and then moved outwards, some 2-3 horse widths he alleged, and checked Mr Bothamley's mount.

Mr Ching submitted that the Committee should give Miss Spittles some credit for admitting the breach. He said that she was a rider of limited experience but has been riding for some time. Miss Spittles said that she has had about 90 rides. She was well aware of her obligations, Mr Ching said. The breach was at the lower end of the scale ? it was only for a stride but Mr Bothamley had to take hold and it had cost him momentum. Rider safety was also compromised, Mr Ching said. He said that the Committee should look at a term of suspension. In response to a question from the Chairman, Miss Spittles advised that she had not previously been charged with any breach.

Miss Spittles and Mr Parsons declined the opportunity to comment either on the incident or in relation to penalty.

In determining penalty, the Committee took into account Miss Spittles' admission of the breach, her previous clear record and Mr Ching's submission that the breach was at the lower end of the scale. The Committee gave Miss Spittles a discount of one day for those matters and suspended her licence up to and including Sunday, 22 October 2006 ? effectively 2 riding days.
