DECISION AND REASONS:

Following the running of Race 3, Anglican 2006 Celebrating 150 Years Maiden, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr B Hibberd, alleging careless riding in that Mr Hibberd allowed his mount, RACING SPIRIT, to move outwards with approximately 600 metres to run when not sufficiently clear causing BISCUIT GREEN (T C Sasada) to check.

Mr Hibberd was present at the hearing of the information and did not admit the breach.

Mr Sasada, the rider of BISCUIT GREEN, gave evidence and Mr M G Humphries, Assistant Stipendiary Steward, showed rear-on and side-on video replays of the incident with approximately 600 metres to run.

Mr Hibberd cross-examined Mr Sasada, made submissions in relation to the incident and used the video replays.

--

Following a deliberation, the Committee delivered the following oral decision:

--

"We have listened to the evidence of Mr Sasada and Mr Humphries and to the submissions of Mr Ching and, of course, we have listened to the evidence of Mr Hibberd and we have carefully viewed the video replays.

--

--

Mr Sasada began by saying that his receiving interference was the result of the inside horse moving out putting pressure on him and forcing him to pull back to avoid clipping heels. Subsequently, when being cross-examined by Mr Hibberd, he conceded that, at some point, he had also been pressured from the outside when SPUN GOLD, ridden by A Mundy, moved in.

Mr Hibberd's defence was that he and Mr Sasada had been competing for the same gap that became available when SPUN GOLD moved wider rounding the bend. Mr Hibberd said that he was entitled to the gap on the basis that he was ahead of Mr Sasada at that point. Mr Hibberd submitted that, initially, there was room for two horses but that the gap narrowed when SPUN GOLD moved back down. Mr Hibberd also conceded that he had made contact with Mr Sasada's mount.

Mr Ching submitted that the inward movement by SPUN GOLD was "secondary" and that clearly, he submitted, the primary interference was caused by Mr Hibberd shifting ground outwards when not sufficiently clear of Mr Sasada's mount.

The Committee's own interpretation of the video evidence concurs with Mr Ching's version of what happened ? in other words, we believe that Mr Hibberd shifted ground outwards when not sufficiently clear of Mr Sasada?a mount causing Mr Sasada to have to restrain his mount. The Committee finds that the contribution of SPUN GOLD had little or no bearing on the interference that was suffered by Mr Sasada which, we find, was the result of the actions of Mr Hibberd.

Accordingly, we find the charge of careless riding against Mr Hibberd to be proved."

In relation to penalty, Mr Ching said that Mr Hibberd's record was "exemplary". His last careless riding breach was on 9 November 2005 when he received a 2-days suspension. Mr Ching submitted that the careless riding on this occasion was in the "medium range" and that a suspension was called for.

Mr Hibberd said that he would like a fine rather than a suspension. He referred to his record of which, he said, he was proud. He submitted that he was not "totally guilty" of the charge. He said what happened was not intentional. He acknowledged that Mr Sasada had been "quite badly checked" but both horses were first starters. Mr Ching said that he would have no objection to a fine but it would have to be a substantial one.

The Committee took into account the submissions of the parties and, in particular, Mr Hibberd's good record. However, the Committee agreed with Mr Ching that the breach was in the medium range. Mr Hibberd had angled his mount out when not clear of Mr Sasada and had caused a significant check to BISCUIT GREEN, which had been favourite for the Race. The safety of other horses and riders had been placed in jeopardy. A suspension was the appropriate penalty in the Committee's view.

Mr Hibberd's licence was suspended up to and including Saturday, 28 October 2006 ? effectively, 3 riding days.
