Following the running of Race 2, Ballantynes Premier, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Jockey, Mr J S Bullard, alleging a breach of Rule 638 (1) (d) in that Mr Bullard, as the rider of SITUATION in the Race, “allowed his mount to shift out causing NIGHT LIFE (K A Myers) to check near the 200 metres”.

Following the running of Race 2, Ballantynes Premier, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Jockey, Mr J S Bullard, alleging a breach of Rule 638 (1) (d) in that Mr Bullard, as the rider of SITUATION in the Race, “allowed his mount to shift out causing NIGHT LIFE (K A Myers) to check near the 200 metres”.

Mr Bullard was present at the hearing of the information and admitted the breach. The charge was found proved accordingly.

Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
  (d)     careless.

--

Mr Oatham had Mr J M McLaughlin, Stipendiary Steward, show video replays, from three angles, of the incident near the 200 metres. He pointed out Mr Bullard’s mount, under a ride, drift out and take the line of Miss Myers’ mount, NIGHT LIFE. Miss Myers had to take a hold of her mount. Mr Bullard then straightened his mount and Miss Myers got back into the gap before having to check as Mr Bullard came across again.

Mr Oatham said that there was no evidence from any Rider that contact had been made and the Stewards did not allege that there had been. However, on neither occasion was Mr Bullard his own length and another length clear.

Mr Oatham informed the Committee that Mr Bullard’s record was a good one – one charge of careless riding at Timaru on 19 July 2009 for which Mr Bullard received a 5 days’ suspension.

Mr Bullard had allowed his mount to shift ground on two occasions causing interference to Miss Myers’ mount which affected the chances of that horse, Mr Oatham said. He rated the level of carelessness as being “mid-range”. He recommended a suspension “at the lower end” and submitted that a period of 2 weeks would be sufficient.

Mr Bullard said that, on the second occasion, his mount had “dived out quite sharply” and may have shied away from something.  He thought that the mare had “tied up”, which made her difficult to ride out.

Mr Bullard did not seek any deferment of a suspension pursuant to Rule 1106 (2).

In arriving at penalty, the Committee took into account Mr Bullard’s admission of the breach and his good record. The Committee agreed with Mr Oatham that the level of carelessness was mid-range.

The Committee suspended Mr Bullard’s licence for a period of 2 weeks commencing immediately up to and including Sunday, 29 November. That period encompasses 3 South Island riding days at Winton, South Canterbury and Cromwell.
