Following the running of Race 7, the Eat Smart Fruit Bars Intermediate, a protest was lodged by the trainer of ROYAL TEASE, Mr S J Kennedy. He alleged that the winner RIVALDO caused interference to ROYAL TEASE over the concluding stages of the race.
| -- DECISION AND REASON --Summary of Facts --Following the running of Race 7, the Eat Smart Fruit Bars Intermediate, a protest was lodged by the trainer of ROYAL TEASE, Mr S J Kennedy. He alleged that the winner RIVALDO caused interference to ROYAL TEASE over the concluding stages of the race. --Mr Ching explained the incident to the hearing, with the assistance of the video evidence. --Mr Kennedy believed that the interference occurred in the last 50 metres when ROYAL TEASE and RIVALDO were racing clear of other horses in the field. --RIVALDO moved ground inwards and as a consequence, Ms Chesmar, the rider of ROYAL TEASE, had to stop riding, and as a consequence of that, ROYAL TEASE lost all momentum. Mr Kennedy submitted that it cost ROYAL TEASE the chance of finishing at least in second place. --Ms Chesmar supported Mr Kennedy and said that RIVALDO only gained ground on her mount when it began rolling inwards. She also stated that from her perspective, RIVALDO was not its length and another length clear when passing. --In reply, Mr K. Hughes, the trainer of RIVALDO, maintained that there was no contact between horses and that there was no need for Ms Chesmar to have stopped riding. He submitted that ROYAL TEASE "shied" away from RIVALDO and that Ms Chesmar should have kept riding with vigour. --Decision --We are of the view that Ms Chesmar's action in "stopping riding" made the incident look a lot worse than it actually was. She was perhaps over cautious. There was plenty of room on the inside for her to keep going in a competitive fashion. Be that as it may, the end result was that there was some interference. However, in order for us to then go on and find that the interference affected the chances of ROYAL TEASE, we must look at other factors. The second and third placed horses finished very quickly down the outside of ROYAL TEASE. The margin between 1st and 2nd was ? length, between 2nd and 3rd ? ? length, and 1 length between 3rd and 4th. Furthermore, we do not agree that there was a passing movement involved as Ms Chesmar alleges. ROYAL TEASE was on the hind quarters of RIVALDO. We also tend to the view that ROYAL TEASE was at the end of its run and would not have improved in any event. The incident occurred more than 50 metres out from the post. It was between 75 and 100 metres from the post. --Thus, taking these factors into account, we are not satisfied that the interference affected ROYAL TEASE's chances to such a degree as to warrant a change in the placings. --The protest is dismissed. ----
