Decision:

Following the running of Race 10 at the Canterbury Jockey Club’s meeting on Wednesday 12th November 2008, Mr R Stam, Licensed Jockey, was charged with careless riding pursuant to Rule 871(1)(d) of the Rules of Racing.

THE FACTS

Mr Stam pleaded guilty to the charge which is therefore deemed to be proved.

The evidence was that Mr Stam allowed his mount to shift ground inwards when not sufficiently clear, causing a check to “Bring It On” ridden by J Todd, near the 1100m mark.

Mr George showed video coverage of the incident from the back straight and side on cameras.  The video coverage demonstrated that Mr Stam moved from a four to five wide position to a two wide position, and took Mr Todd’s line in the process, when he was not sufficiently clear.

We heard details of Mr Stam’s riding record.  He has been suspended on three occasions this year, in January, April and July, when suspensions of five days, six days and four days respectively, were imposed.  Mr George described the degree of carelessness as being at the higher end of the scale.  Having regard to the evidence, we are inclined to agree with that assessment.

A suspension is the appropriate penalty.  Mr Stam told us that he normally rides in the Central Districts only, but we accept that there was a possibility of him picking up a ride on Saturday 15th November 2008.  It was not a firm riding engagement, and therefore Mr Stam did not ask for a seven day deferment of the suspension.

PENALTY DECISION

Mr George submitted that a suspension of between four and six days should be imposed.  Having regard to Mr Stam’s record, we do not agree with that assessment and consider that a starting point for penalty would be in the region of seven to eight days.  However, we will give Mr Stam credit for his guilty plea and instead, we are going to set the penalty in terms of weeks rather than riding days.  Mr Stam will be suspended for a period of four weeks.  The period of suspension commences at the conclusion of racing today, 12th November 2008, until the conclusion of racing on Wednesday 10th December.  We believe that that may encompass about six riding days for Mr Stam.
