Following the running of Race 8, PGG Wrightson 132nd Grand National Steeplechase, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr T J Hazlett, alleging that Mr Hazlett, as the rider of the winner, BOGEYMAN, made a celebratory gesture prior to the winning post, in breach of Rule 871 (3) of the Rules of Racing.

DECISION AND REASONS:

Following the running of Race 8, PGG Wrightson 132nd Grand National Steeplechase, an information was filed by Stipendiary Steward, Mr S C Ching, against Licensed Jockey, Mr T J Hazlett, alleging that Mr Hazlett, as the rider of the winner, BOGEYMAN, made a celebratory gesture prior to the winning post, in breach of Rule 871 (3) of the Rules of Racing.

Mr Hazlett was present at the hearing of the information and admitted the breach. The charge was found to be proved and the hearing proceeded in relation to penalty.

Rule 871 (3) provides as follows:

--

Every rider commits a breach of these Rules who in the opinion of the Judicial Committee makes a celebratory gesture prior to his horse passing the winning post.

Mr Ching had Mr J M McLaughlin, Assistant Stipendiary Steward, show a video replay of the final stages of the race. Mr McLaughlin pointed out Mr Hazlett in the lead, have a look and stand up and make a clear "celebratory gesture" at least six strides short of the winning post.

Mr Ching said that he had spoken to Mr Hazlett earlier in the day concerning a celebratory gesture he had made after winning the Grand National Hurdles. Mr Ching said that he had complimented Mr Hazlett for making that gesture "right on the post".

Mr Hazlett stated that he was well aware of the Rule and realised that he was breaking the Rule by making the celebratory gesture. He submitted that he was "in control at all times" and added that, for jumping races to survive, it was necessary to get the crowd involved and "they loved it".

In relation to penalty, Mr Ching submitted that the breach could be dealt with by way of a fine, as is normal for breaches of the particular Rule. Mr Ching acknowledged that fines had been in the vicinity of $300 for a first offence but he referred to the fine of $750 imposed on J S Bullard, the rider of the winner of the $1 million Kelt Capital Stakes in 2004.

The Committee took into account Mr Hazlett's very frank admission of the breach and the fact that the gesture appeared to have been made with safety. In addition, Mr Hazlett had not previously beached the Rule. However, it was a wilful and blatant breach of the Rule.

Mr Hazlett was fined the sum of $300.00.
