As Mr Bosson admitted the breach we found the charge proved.

Mr Bosson is suspended for 2 weeks, from the close of racing on Saturday November 18th, up to and including racing on Saturday December 2nd.
Facts:
Following the running of Race 7 (AL Basti Equiworld 45th NZ 2000 Guineas Group1), an Information was lodged by Mr J Oatham alleging a breach of Rule 638(1)(d) in that O Bosson allowed his mount EMBELLISH to shift in when not clear crowding BOSTONIAN who was forced inwards checking SCOTTBASE (M DuPlessis) near the 1400 metres.
Rule 638(1)(d) provides: A Rider shall not ride a horse in a manner which the Judicial Committee considers to be careless.
Mr Bosson confirmed to the Committee that he understood the charge and that he admitted the breach.
Mr Oatham had Mr Davidson show the incident using all available camera angles. Using the head-on view he identified the three horses involved. Mr Bosson (EMBELLISH) started from barrier 5 with BOSTONIAN to his immediate inside in barrier 4 and SCOTTBASE in barrier 3. Soon after the start Mr Bosson came across when not sufficiently clear of BOSTONIAN moving that runner inwards into the line of SCOTTBASE who had to be checked.
Mr Bosson said he didn’t force any horse inwards intentionally. He believed his inward movement was quite minimal and at that time he didn’t realise that Mr Du Plessis was still there in the position he was.

Mr Oatham produced Mr Bosson’s record which showed four careless riding charges over the last 12 months:

He said an aggravating factor was that today’s breach occurred in a Group 1 race worth $500,000, one of the more important races for 3yr olds on the NZ Racing Calendar. In assessing the incident overall the Stewards considered it to be a midrange breach. Mr Oatham said, given the fact that Mr Bosson went on to win the race, the Committee might consider adding a fine onto the penalty. He did say however that it was the Stewards’ opinion, that on this occasion Mr Bosson made an error of judgement rather than displaying a “win at all cost” mentality, therefore the addition of a fine may not be necessarily appropriate.
Mr Bosson advised that he had riding commitments through until next Saturday and requested a deferment until after that date.
Reasons for Penalty:
The Committee began with making an assessment on Mr Bosson’s overall degree of carelessness.The head-on film was the most helpful in showing that soon after the start, Mr Bosson moved across in a gradual and relatively measured manner. He did not make a sudden or sharp inward movement, supporting the evidence given that this was an error of judgement, rather than a blatant disregard for other runners. We then factored in the check received by SCOTTBASE and concluded that the breach sat within midrange.
We adopted the midrange starting point of 8 riding days as outlined in the Penalty Guide for Judicial Committees. The Group 1 status of the race and the stake of $500,000 were significant aggravating factors for which we applied an uplift of three days. An additional monetary penalty would have been imposed by this Committee, had Mr Bosson gained an advantage by pushing out of a gap, or forcing a run closer to the finish.
Mr Bosson is an in-demand rider and due to the fact that it has been six months since his last suspension we considered his record to be a neutral factor in assessing penalty.
In mitigation we considered Mr Bosson’s ready admission of the breach and afforded him a one day discount.
