Facts:
Following the running of Race 5, Brackenfield Hunt Premier Open, an information was filed by Stipendiary Steward, Mr J P Oatham, against Licensed Jockey (Class A), Mr R J Hannam, alleging a breach of Rule 638 (1) (d) in that Mr Hannam “permitted his mount TICK TOCK TURBO to shift inwards near the 1100 metres when not sufficiently clear of FLYING ALIBI (L M Allpress) which was checked hampering OUR BEE JAY (D G Bradley).”
Mr Hannam was present at the hearing of the information and he indicated that he admitted the breach.
Rule 638 provides as follows:
(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.
Submissions for Decision:
Mr Oatham had Stipendiary Steward, Mr J M McLaughlin, show head-on and side-on video replays of the incident with approximately 1100 metres to run, 300 metres after the start of the 1400 metres event. He pointed out TICK TOCK TURBO, ridden by Mr Hannam, with FLYING ALIBI (L M Allpress) on his inner. Mrs Allpress was established on the inside against the fence when Mr Hannam came across and took the line of Mrs Allpress, causing her to check her mount. OUR BEE JAY (D G Bradley), which was following those runners, received some interference as a consequence.
Mr Hannam accepted what Mr McLaughlin had said. However, in mitigation, he said that his mount had its near front leg outside the rump of the runner he was following. He was, therefore, still one off the fence and there was still room for Mrs Allpress’ mount on the inside, he submitted. However, Mr Hannam admitted that he had come in and taken Mrs Allpress’ line slightly.
Submissions for Penalty:
Mr Oatham informed the Committee that Mr Hannam has an excellent record with no careless riding breaches within the last 12 months. Mr Hannam rides extensively in the Southern and Central regions, Mr Oatham said. He added that the Stewards have some sympathy for the matters put by Mr Hannam, but he had shifted in to a point where Mrs Allpress had to check her mount. However, the shift was quite slight and Mr Hannam had not shifted fully into the line of Mrs Allpress who had been attempting to hold her place. Also, Mrs Allpress’ mount may have also overreacted slightly. Mr Oatham said that the Stewards assessed the incident as “low range”. He submitted that a term of suspension was called for but, in all of the circumstances, he submitted a 3-days’ suspension was appropriate.
Mr Hannam told the Committee that he was seeking a 7-days’ deferment of suspension because he had engagements at the meeting of Otaki-Maori Racing Club on 18 August. Mr Oatham informed the Committee that the meetings at which Mr Hannam would be likely to ride after that date were at Taupo on 20 August, Woodville on 23 August, South Canterbury on 24 August and New Plymouth on 25 August.
Reasons for Penalty:
In determining penalty, the Committee had regard, as mitigating factors, to Mr Hannam’s riding record (described by Mr Oatham as “excellent”) and his very frank admission of the breach. In addition, the Committee accepted Mr Oatham’s submission that the breach was in the low range for the reasons which he gave. The Committee agreed to the 7-days’ deferment of suspension sought by Mr Hannam to which Mr Oatham had no objection.
