ALLEGED:
That Ms C Lunn, the rider of “Matryoshka” rode carelessly by permitting her mount to shift inwards taking “Lights Up” (M Coleman) inwards, causing crowding to “Bellonet” (O Bosson), “Figure Again”, (H Tinsley) and “Platinum Dancer”,
(J Riddell) which checked.
Rule 638(1)(d) reads as follows:
“A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:
(d) careless.”
THE EVIDENCE:
Mr Davidson, Stipendiary Steward, demonstrated the incident on the video coverage using the back straight camera which provided a head-on view of the incident and the side-on view.
Ms Lunn’s mount was drawn 11 at the barrier in a 16 horse field. Her mount started keenly, and Ms Lunn began an inwards movement looking for a run closer to the rail.
However, in the process, she allowed her mount to shift inwards on to ‘Lights Up”
(M Coleman) when she was not clear. As a consequence of this, three other runners inside of “Lights Up” namely “Bellonet”, “Figure Again” and “Platinum Dancer” were inconvenienced with the end result being that “Platinum Dancer” was checked.
By way of comment on the incident, Ms Lunn told the hearing that Mr Coleman, the rider of “Lights Up” told her to go forward if she could, but it seems that Ms Lunn (“Tom Thumb”) was having a little difficulty with her mount as she said that it was racing in a bit which did not seem to suit it. Her horse was not travelling well as it was “fighting the bit”.
Mr PDJ Harris, Ms Lunn’s employer, told the hearing that Mr Coleman did assist quite significantly by endeavouring to hold Ms Lunn out, but “Bellonet” also was contributing to the buffeting to horses inside it.
Mr Harris also pointed out that Ms Lunn was looking to her inside which is what is required of a jockey in such a situation.
PENALTY SUBMISSIONS:
Mr McLaughlin, who presented the information, advised the hearing that the Stipendiary Stewards considered that the degree of carelessness was in the mid range, and that a four day suspension ought to be imposed. Ms Lunn is inexperienced, in that she has only had 29 race day rides in total so far.
It was confirmed that Ms Lunn has no riding commitments within the next seven days.
We delivered the following penalty decision on Race Day:
“Ms Lunn has pleaded guilty to a charge of careless riding. She caused interference to several other runners shortly after the start in a 1400 metre race by moving across on to “Lights Up” (M Coleman) when not clear. As a consequence, other horses inside “Lights Up” were crowded, although we accept that ‘Bellonet” may have contributed to some jostling to horses inside it, to a degree.
Having regard to the level of carelessness, described by medium range by the Stipendiary Stewards, the starting point for the imposition of penalty is, in our view, a suspension of five days.
We are, however, able to give Ms Lunn credit for the following:
· Her early guilty plea.
· Her good record, even though she has had only 29 race day rides and thus is inexperienced.
· Her honest and open candour in the hearing.
· No particular advantage was gained by her carelessness.
There are no aggravating factors. Even though the incident occurred on a Premier Day, it was not a Group or Listed Stakes Race.
The discounting factor that we apply is that of two South Island race days.
Thus, Ms Lunn is suspended from the conclusion of racing today, 13th November 2010, up until (and including) Sunday 28 November - three days.
