| -- DECISION AND REASON --Following the running of Race 5, Provincial Finance Maiden, an information was filed by Stipendiary Steward Mr S.C. Ching, against licensed jockey Mr T.R. Moseley, alleging that Mr Moseley, as the rider of OTARAMA in the race, rode carelessly in that near the 500m he angled out sharply, making firm contact with THE THAR (JD Laking), forcing that runner out of its rightful line of running. --Mr Moseley admitted the breach. --The Committee viewed the video replays of the race and listened to the submissions of Mr Ching and Mr Moseley, and the evidence of Mr McCutcheon. --In considering penalty for the breach, the Committee has had regard to the following matters: --1. Mr Moseley's very frank admission of the breach. ------2. Mr Moseley's riding record. The Committee notes that although Mr Moseley has had two careless riding breaches in the past 12 months, the last was almost nine months ago. The Committee recognises that Mr Moseley would have had a large number of rides in the intervening period, being one of the South Island's senior and most traveled jockeys. --3. Mr Moseley's submission that his mount had over-reacted and had contributed to the incident. --4. Mr Ching had submitted that the race was one at a "Premier Meeting". The Committee notes the provisions of Rule 1122(2) which refers to the status of the race and the stake payable, but notes that no reference is made to the status of the meeting. So, in determining penalty, the Committee has taken into account as submitted by Mr Moseley, that the race was a $7,000 race for maidens. --5. Mr Ching has recommended a suspension in the range of 6 ? 8 days. In the Committee's view, this breach, taking into account the matters I have mentioned, does not warrant a term of suspension of that length. --Taking all matters into account, the Committee has determined that Mr Moseley will be suspended for a period commencing after the close of racing on Saturday 13 November up to and including 10 December next. This is a minimum of 4 riding days and may include other days on which Mr Moseley may have had the opportunity of riding at a North Island meeting. ---- --
