Excessive use of the whip.

Facts:

Following the running of Race 3, the Mid Winter Raceday – June 23 Rating 75, an information was filed by Stipendiary Steward Mr A. L. Ray alleging a breach of Rule 638(3)(b) by Licensed Jockey Mr M. Cameron in that he used his whip excessively.

The information reads as follows:

“I the above named informant allege that the above named Respondent committed a breach of Rule 638(3)(b) (in that) excessive use of the whip prior to the 200m when riding ”Astronomical”.”

Rules 638(3)(b) reads as follows:

“(3) A Rider shall not:
(b) strike a horse with a whip in a manner or to an extent which is unnecessary, excessive or improper;”

Mr Cameron had indicated on the information that this breach was admitted, and he confirmed this at the hearing. He also agreed that he understood the charge and the Rule it was brought under.

Submissions for Decision:

Mr Ray gave evidence and used video coverage to show that prior to the 200 metre mark Mr Cameron had used his whip on eleven occasions without a noticeable pause, which is in breach of the “Guidelines With Respect To Acceptable Use Of The Whip”. These guidelines state that after a horse enters the final straight it can be hit with the drawn whip up to six times, and then a rider should ride hands and heels for six strides before hitting the horse again with the drawn whip. These actions should continue until the 200 metre mark, at which stage it is acceptable for the rider to use the drawn whip continuously to the winning post, if the horse is holding its position or improving.

Mr Cameron did not dispute the facts of this matter.

Reasons for Decision:

As Mr Cameron had admitted the breach it was found to be proved in accordance with Rule 915(1)(d).

Submissions for Penalty:

In relation to penalty Mr Ray advised that Mr Cameron had previously breached this Rule on 4 June 2011, 6 February 2012 and 15 May 2012, having been fined $200-00 on each occasion. Mr Ray said that Mr Cameron had a good record considering the number of rides he has (about 950 so far this season), and submitted that a fine in the vicinity of $300-00 should be imposed in this case.

There was discussion about the breach on 4 June 2011 and we decided that this breach should be discounted as it was within days of being a year old.

Mr Cameron had no submissions to make with regard to penalty.

We adjourned to consider the matter of penalty.

To Mr Cameron’s credit he has admitted the breach, and it also needed to be taken into account that he is a very busy rider. On the other hand this is his third breach in the last four months which is unacceptable. As mentioned above we have discounted the previous breach on 4 June 2011. Taking all these matters into account we decided that a fine of $350-00 would be appropriate in this case.
