An Information was lodged by Stipendiary Steward Mr T W TAUMANU alleging that driver D J BUTCHER drove without both feet in the footrests of his sulky throughout Race 2 in breach of Rule 867.
--Mr Butcher admitted the charge and was present for the Hearing.
--Mr Taumanu in referring the video footage of the concluding stages of the race showed Mr Butcher with his right foot out of the footrest with about 150 metres left to run. He explained that whilst at the lower end of the offending scale Mr Butcher was a very senior horseman whose actions were carefully watched by junior drivers who held him in awe. He needed to be setting an example to other industry participants.
--In mitigation Mr Butcher said Camber Lad was a big horse and accordingly the cart was a long way out. He had taken his right foot from the footrest in the concluding stages to help him balance in the run home.
--Mr Taumanu recommended a fine of $100.00. Mr Butcher accepted this as a fair penalty.
--According a fine of $100 was imposed.
