Information 13640 instigated a protest by Stipendiary Steward T. W. Taumanu against RHYTHMIC ROSE (B.Mangos) placed third by the judge alleging interference to FLIGHT OF FANTASY (J. Abernethy) placed sixth approximately 75 metres from the finish in Race 5 the NZ Sires Stakes 3YO Fillies Heat.

Mr. Muirhead confirmed that he viewed the incident from his position in the main stand and observed FLIGHT OF FANTASY coming into contact with RHYTHMIC ROSE as that horse was improving on the inside using the passing lane in the run home. Demonstrating the incident on the videos he noted that Mr. Abernethy had come out on the turn allowing Mr. Mangos to use the passing lane. As he improved keeping a straight line initially he then ran out about three-quarter's of a sulky width coming into contact with FLIGHT OF FANTASY causing it to break and lose any chance at that stage. He referred to an earlier movement in from the horse outside Mr. Abernethy but that was prior to the incident he said and had no bearing on it.

Mr. Abernethy, the driver of FLIGHT OF FANTASY, confirmed there had been tightening from the outside and from the inside as he came down the straight. He agreed, however, it was as a result of the movement from the inside horse that made contact with the legs of his horse that caused it to break.

Mr. Mangos stated that his horse had taken the passing lane when it became available and had come out as she tired which she tended to do. He thought she had come out a couple of feet but not enough to check any other runner. He accepted she moved out fractionally towards FLIGHT OF FANTASY but prior to this that horse had been tightened by pressure on its outside. Its line had been taken preventing it from improving and this was, in his view, the major factor in causing it to break rather than the pressure coming from his horse. Had the horse on the outer kept straight then the resulting interference would not have occurred and this, he said, is clear on the video. He also insisted that he straightened RHYTHMIC ROSE when it ducked out and the resulting break looked worse than it would otherwise have been without the pressure from the outside horse and in the end it was a fifty-fifty call as to where the fault lay for the interference.

Mr. Taumanu agreed there had been movement from the outside but did not agree that it caused or contributed to the interference. It was all caused, he said, by movement out by RHYTHMIC ROSE, as the video showed.

The Committee, after taking these matters into consideration, is satisfied the evidence establishes there was interference as alleged by RHYTHMIC ROSE to FLIGHT OF FANTASY and it has to determine whether that interference affected its chances. Mr Mangos said the interference was caused or contributed to by tightening from the horse on the outer and the Committee accepts that tightening did occur. It is not satisfied on the evidence that such movement caused the horse to break and is satisfied such interference was caused by the movement out by RHYTHMIC ROSE. It is also satisfied on the evidence that such interference has affected the chances of FLIGHT OF FANTASY and therefore exercises its discretion to uphold the protest because of the severity of such interference and the stage of the race at which it occurred. RHYTHMIC ROSE is therefore relegated behind FLIGHT OF FANTASY and the amended placings for the race are now
