--An Information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu following the running of Race 10 alleging a breach of Rule 869(7B) by the horse VINNIE BARBARINO in that its sulky wheel moved inside the marker line for more than 30 metres in the last 600 metres of the race.

Driver Mr T MITCHELL and part owner Mr L SEEDS represented VINNIE BARBARINO which was placed third by the Judge. They did not contest the protest.

Video footage of progress at the home turn clearly showed the sulky wheel to protrude inside the marker line and to travel over or knock out at least 5 marker pegs a distance in excess of thirty metres.

Mr Mitchell conceded this had occurred but submitted the horse was hanging very badly and had not gained any advantage by the inwards movement.

Clearly Vinnie Barbarino has breached Rule 869(7)(B) and as such is subject to mandatory disqulaification.
