An information filed by Stipendiary Steward Mr T Taumanu, against Mr I Marks, driver of FREIGHT TRAIN, alleging a breach of Rule 869 (3) (b) - Careless driving - in that he moved his horse inwards with about 300 metres to run, causing a severe check to HUNTER HILLS



An information filed by Stipendiary Steward Mr T Taumanu, against Mr I Marks, driver of FREIGHT TRAIN, alleging a breach of Rule 869 (3) (b) - Careless driving - in that he moved his horse inwards with about 300 metres to run, causing a severe check to HUNTER HILLS driven by Ms A Donnelly. Mr Marks admitted the breach and was present at the hearing.

Stipendiary Steward Mr J Muirhead demonstrated the incident by use of the video film. Mr Marks moved FREIGHT TRAIN to a four wide position and then moved the horse back to a three wide position and in so doing caused severe interference to HUNTER HILLS. The chances of HUNTER HILLS were seriously affected. Mr Marks acknowledged Mr Muirhead's interpretation was correct.

PENALTY

Mr Taumanu said Mr Marks had a clear driving record and did not drive very often. He suggested suspension of Mr Marks' horseman's licence up to and including 23 November - effectively 4 days. If a fine was to be imposed, he suggested it should be in the range $300.00 - $400.00. Mr Marks said he preferred a suspension.

In fixing penalty I took into account the following :

  1. The guilty plea. --
  2. Mr Marks' clear driving record --
  3. The offending was above the midpoint on the scale of seriousness. --
  4. The submissions of Mr Taumanu. --
  5. The submissions of Mr Marks. --
  6. Mr Marks only drove infrequently.

Balancing those matters, I suspended Mr Marks' horseman's licence until the conclusion of racing on 23 November 2007, which is effectively 4 days.
