Horseman Mr F Cooney was charged with failing to maintain his barrier position with Shard's Of Cullen at the start of race 5.

Facts:

Mr Cooney appeared before the committee and admitted the breach.

Stipendiary Steward Mr Taumanu explained that Mr Cooney drawn barrier five on Shard's of Cullen was approximately one and a half lengths away from the mobile barrier at the point of despatch.

Mr Cooney in mitigation explained that the horse was having its first start and he had been cautioned by the trainer that Shard's of Cullen could put in a "rough step".  He had taken the precaution of giving the horse a little more space to avert potential problems at the start.

Mr Taumanu said the starting point for this breach was a fine of $250.00. Mr Cooney was a very experienced driver with a clean driving record who admitted the breach.  The offending was mid range in his assessment.

Mr Cooney explained that he was trying to educate a young horse and had been cautious in his approach to prevent any mishap at the start.  He believed that a fine of $250 was excessive.

Reasons for Penalty:

The committee in fixing the penalty took into account Mr Cooney's excellent driving record and reputation and accepted the mitigating reasons.  The commitee accepted the Stipendiary Steward's assertion that the offence was mid range and that Mr Cooney's guilty plea be recognised.
