Following the running of race No 7, an information was filed instigating a protest.       This protest was against horse No 11 placed 3rd by the judge

Following the running of race No 7, an information was filed instigating a protest.

--

This protest was against horse No 11 placed 3rd by the judge on the grounds that Beach Connection was in breach of the above rules in that during the run home Beach Connection did strike several "Track Marker Pylons" and it was alleged that this horse gained an advantage by going inside of these marker pylons.

Present at the hearing of this information were Mr. R Downey Jnr Horseman assisted by Mr. Jaeson Teaz a senior horseman.

The Judges placings were 1st No 5, 2nd No 6, 3rd No 11, 4th No 2, 5th No 9, 6th No 1.

Mr. Escott opened his case by showing the video of the run home this showed Beach Connection progressing up the passing lane and as this horse progressed up the straight the video clearly showed Beach Connection to strike and run inside of at least six "Track Marker Pegs". Mr. Escott submitted that Beach Connection was clearly in breach of the rule and had gained an advantage by coming up the passing lane and coming inside these Track Marker Pylons.

The Stipendiary Stewards advised that the track marker Pylons are 18 meters apart and alleged that Beach Connection was in breach of the above rules as this horse was inside the Marker Pegs for a distance in excess of the 30 meters in the last 600 meters of this race as stated in subclause 7(b).

Mr. Downey was shown the video and the chairman asked that in view of the video evidence did he acknowledge that he was indeed in breach of this rule. Mr. Downey acknowledged he was in breach of the rules and also that he was not forced inside the Marker Pylons by any other horse.

Mr. Teaz who assisted Mr. Downey also stated that Mr. Downey was not forced over the marker pegs by any other horse

Decision And Reasons.

--

This judicial committee finds that Beach Connection was in breach of rule 869 (7a) (a) (b) and (7b). I find that Beach Connection has gained an advantage by going inside the Marker Pegs in the run home and this horse was inside the Marker Pegs for a distance greater than is allowed under the rules.

--

The driver of Beach Connection Mr. Downey admitted that he had broken the rules by obtaining a run which he was not entitled to receive.

--

For all of the above reasons I order the disqualification of Beach Connection from 3rd place in this race .

The amended placings shall no read 1st No 5, 2nd No 6, 3rd No 2, 4th No 9, 5th No 1, 6th No 7.
