Decision:

Following the running of race No 10, an information was filed instigating a protest.    The informant was Mr. N R Escott and this was a protest against horse No 2 Poeme driven by Mr. D M Alexander which finished 3^rd in race no 10.

Following the running of race No 10, an information was filed instigating a protest.

The informant was Mr. N R Escott and this was a protest against horse No 2 Poeme driven by Mr. D M Alexander which finished 3^rd in race no 10.

The judges placings were 1^st No 5, 2^nd No 11, 3^rd No 2, 4^th No 9, 5^th No 8, 6^th No 3.

Mr Alexander was present at this hearing and Mr. Escott called Mr. P Hall as a witness.

Mr. Escott opened his case by showing the video of the run home, this showed Malcolm Randle leading into the straight followed by Benromach (Mr. P Hall) and Poeme ( Mr D Alexander ) trailing Benromach. Malcolm Randle skipped clear and Mr. Hall came off the pole line and kept a straight line for a distance Mr. Alexander angled Poeme into the passing lane and was forced over the marker pegs by Benromach. Mr. Escott acknowledged that Benromach had been hanging inwards and had in fact forced Poeme over some marker pegs.

Mr. Hall stated that his horse had run in and he had corrected it .

Mr. Alexander stated in evidence that his horse had been forced over the marker pegs by the actions of Mr. Hall's horse Benronmach running in.

Mr. Alexander also stated that at the top of the straight there was room for him to take the passing lane as Mr. Hall had no reason to go into the passing lane, the leading horse, and eventual winner Malcolm Randle was several lengths in front of the field.

This Judicial Committee acknowledges that Poeme did run over several Marker Pegs in the run home. I find that Mr Alexander was entitled to angle his horse Poeme into the passing lane as he was entitled to this run. Mr. Hall is obliged under the home straight regulations to keep his horse in a straight line to the finishing line this he did not do as his horse ran inwards forcing Poeme over the marker pegs. It is clear from the video evidence that Mr. Hall did correct his horse in the run home and this was also acknowledged by Mr. Escott and Mr. Hall. The video evidence clearly shows Benromach coming in and forcing Poeme over the marker pegs. Under the provisions of rule 869 7b it is a defence to this rule if it can be established that interference was caused by another horse or horseman. This I find to be so as Benromach caused interference to Poeme in the run home and by running inwards forced Poeme over the marker pegs.

For all of the above reasons this Judicial Committee dismisses the protest and orders that the judge's placings stand.
