Cambridge HRC - 4 January 2013
Meet Chair:
JHolloway
Meet Committee Member 1:
ADooley
Race Date:
2013/01/04
Race Number:
R4
Decision:
Accordingly Mary Anastasia is relegated to 10th place and the Judges placings amended as follows:
1st - 1 Rocknroll Lass
2nd - 2 Cullies Delight
3rd - 7 Sofia Loren
4th - 12 Maheer Melody
5th - 10 Lislass
Authority was given to pay on the adjusted placings.
Facts:
An Information instigating a protest was lodged by Stipendiary Steward, Mr Ydgren following the running of race 4 against horse 5 'Mary Anastasia' (N Chilcott) placed 3rd by the Judge on behalf of the connections of horse 3 'Maddy's Star' (T Grayling) placed 9th by the judge and horse 4 'Souvenir Glory' (B Holmes) placed 10th. The protest alleged a breach of Rule 869 (4A) when 'Mary Anastasia' moved inwards entering the first bend causng a check to 'Souvenir Glory' which in turn caused interference to 'Maddy's Star'.
Miss Chilcott appeared for the connections of Mary Anastasia and contested the protest.
Messrs Grayling and Holmes appeared for the connections of Maddy's Star and Souvenir Glory respectively.
The Judges placings were
1st - 1 Rocknroll Lass
2nd - 2 Cullies Delight
3rd - 5 Mary Anastasia
4th - 7 Sofia Loren
5th - 12 Maheer Melody
Mr Grayling confirmed that he had received pressure from his outside entering the first bend. He had eased out of it and in doing so his horse had galloped settling well back in the field. His chances had been affected.
Mr Holmes confirmed there had been pressure from his outside from Miss Chilcott and he had called out to her for room before being forced down on to Mr Grayling's horse. His chances had not been overly affected.
Mr Muirhead referred the committee to video footage of the early stages of the race and identified the respective runners. He indicated where Mr Holmes had to take hold of his drive shifting in marginally as Miss Chilcott moved inwards entering the first corner dictating his ground.
Mr Holmes contacted Mr Grayling's wheel and 'Maddy's Star' broke. Miss Chilcott had not given them enough room when improving.
Miss Chilcott told the committee that 'Souvenir Glory' was running erractically and the outwards movement from the horse drawn 1 had contributed to the pressure on 'Maddy's Star'.
Submissions for Decision:
Mr Ydgren submitted that in the event the protest was upheld, pursuant to Rule 869 (8) that 'Mary Anastasia' be relegated to 10th place, immediately behind 'Souvenir Glory'.
Reasons for Decision:
The Committee reviewed video footage of the early stages of the race. It was clear that this footage supported the version of events as described by Messrs Holmes Grayling and Muirhead.
Miss Chilcott had moved inwards entering the first bend when not sufficiently clear of Maddy's Star and Souvenir Glory resulting in those two horses suffering interference and having their chances affected.
