An Information was lodged by Stipendiary Steward Mr T W Taumanu against Horseman Mr S J Reid alleging that Mr Reid drove his horse carelessly by allowing his horse to run out in the run home causing interference to WOT THE OWL driven by Mr P D Young.

Mr Reid was present and did not admit the charge.

The relevant Rule was read out to Mr Reid.

Mr Taumanu gave evidence by use of the Video Films and also relied on evidence given at the Protest Hearing. Mr Taumanu showed Mr Reid’s horse running out in the home straight and said that Mr Reid continued to drive his horse out even though it was running out and it eventually caused interference to WOT THE OWL by taking that horse's line and causing it to run out of room. Mr Taumanu said that in his view Mr Reid did not take any corrective action and did not use the whip on the right hand side of his horse.

Mr Reid said in his defence that his horse had run out in its last two starts at Cambridge and he didn’t know what else he could do with the horse. He did say that using the whip on the right side would not have made any difference. He said that he had to drive his horse out because it was a very close finish.

In considering all of the evidence before me I find that Mr Reid, in driving his horse, did not take any corrective steps to deal with the racing tendencies that he knew his horse had. I accordingly find the charge proven.

In respect to penalty Mr Taumanu said Mr Reid had an unbelievably clean record and he recommended a fine of $350-00. He also noted that because of the change of placings the affected horse had been promoted. Mr Reid for his part thought that because of those factors the fine should be less than the recommended amount. Having taken all matters into account I fine Mr Reid the sum of $300-00.
