--This is an information filed by Stipendiary Steward Mr T TAUMANU against Mr G ROBB driver of UNATTACHED alleging a breach of the above rule in that he used his whip excessively over the concluding stages of the race.
--Mr ROBB admitted the breach and did not wish to be present at the hearing. He endorsed the information “mitigating factors”.
--Stipendiary Steward Mr J MUIRHEAD showed the video film of the incident. He said Mr ROBB used his whip at least 22 times in the last 350metres of the race. On some occasions Mr ROBB hit the sulky shaft but on other occasions hit the horse with vigour. He said the mitigating factors claimed by Mr ROBB were that the horse was lazy and because of that the connections had told him to show vigour.
--PENALTY
--Mr MUIRHEAD said Mr ROBB had no relevant breaches of the rules recorded against him in the last 12 months and that the recommended starting point for penalty was a fine of $250 or a 1 week suspension. He recommended a fine of $250.
--In fixing penalty the committee takes into account the guilty plea, the submissions of Mr MUIRHEAD, the recommended starting point and the clear driving record. The committee does not accept there are any mitigating factors and views the offending as mid-range on the scale of seriousness. Balancing those matters but with emphasis on the vigour shown on some occasions, a fine of $250 is imposed.
