--This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Junior Horseman Mr R DOWNEY driver of MISTER CROKER alleging a breach of the above rule in that he drove his horse carelessly and caused interference to LIGHTNING MAGIC driven by Mr D CUNNEEN and CLONCULLEN driven by Mr S LAWSON with approximately 850metres to run.

--This is an information filed by Stipendiary Steward Mr J MUIRHEAD against Junior Horseman Mr R DOWNEY driver of MISTER CROKER alleging a breach of the above rule in that he drove his horse carelessly and caused interference to LIGHTNING MAGIC driven by Mr D CUNNEEN and CLONCULLEN driven by Mr S LAWSON with approximately 850metres to run.
--Mr DOWNEY admitted the breach and was present at the hearing assisted by Senior Horseman Mr D BUTCHER.
--Mr MUIRHEAD showed the video film of the incident. He said Mr DOWNEY moved MISTER CROKER inwards from the 3 wide position to 2 wide and contact was made with the legs of LIGHTNING MAGIC which broke for a couple of strides and went back onto CLONCULLEN which also broke for a couple of strides. Mr MUIRHEAD said it was a misjudgement by Mr DOWNEY.
--Mr BUTCHER said there was room for Mr DOWNEY to move inwards and he had been a little bit careless.
--PENALTY
--Mr MUIRHEAD said the recommended starting point for penalty was a fine of $400 and/or a 2 week suspension. He said Mr DOWNEY had been frank, was a top Junior Horseman, had no relevant breaches of the rules recorded against him in the last 12 months and the offending was in the lower half on the scale of seriousness. He recommended a fine of $250.
--Mr BUTCHER accepted that recommendation.
--In fixing penalty the committee takes into account the guilty plea, the submissions of Mr MUIRHEAD and Mr BUTCHER, the clear driving record, the recommended starting point and that the offending was mid to lower end on the scale of seriousness. Balancing those matters but with emphasis on the excellent driving record and our acceptance that this was a case of misjudgement we impose a fine of $250.
