An  information was filed by Chief Stipendiary Steward Mr N Escott against Mr M Jones, driver of BADLANDS JEWEL alleging a breach of Rule 869(3)(b) – careless driving – in that he drove his horse carelessly causing interference to KIWI INGENUITY with approximately 700 metres to run.



DECISION AND REASONS

An  information was filed by Chief Stipendiary Steward Mr N Escott against Mr M Jones, driver of BADLANDS JEWEL alleging a breach of Rule 869(3)(b) – careless driving – in that he drove his horse carelessly causing interference to KIWI INGENUITY with approximately 700 metres to run.

Mr Jones admitted the breach and was present at the hearing.

--

The circumstances of the breach are as described in the associated protest hearing.   Mr Jones moved his horse outwards and his sulky wheel struck the hind leg of KIWI INGENUITY causing that horse to break and lose its chance.

--

Penalty:

--

Mr Escott said Mr Jones had driven in 7675 races, was a senior horseman with an exemplary record with no relevant breaches of the rules in the last twelve months.   He suggested a fine in the region of $500 - $1500 taking into account this was a major race, further suggesting a fine at the lower end of the scale.   He also referred to the guilty plea.

Mr Jones accepted the submissions of Mr Escott and said he believed there were mitigating factors and repeated that his outward movement was gradual.

In fixing penalty, the committee has taken into account the following matters:

--

1.         The guilty plea.

--

2.         Mr Jones’ good driving record.

--

3.         The submissions of Mr Escott.

--

4.         The acceptance of those submissions by Mr Jones.

--

5.         The provisions of Rule 1114(2)(a) – this is a major race.

--

6.         The recommended starting point for penalty is a fine of $600 and/or 3 weeks       suspension.

--

7.         The offending was in the lower half on the scale of seriousness.

--

Balancing those matters, the committee imposed a fine of $750.
