Decision: An information was filed by Chief Stipendiary Steward Mr N Escott instigating a protest on behalf of KIWI INGENUITY driven by Mr R Holmes placed 12th, against BADLANDS JEWEL driven by Mr M Jones placed 5th, on the grounds of interference about 700 metres from the finish of the race.

An information was filed by Chief Stipendiary Steward Mr N Escott instigating a protest on behalf of KIWI INGENUITY driven by Mr R Holmes placed 12th, against BADLANDS JEWEL driven by Mr M Jones placed 5th, on the grounds of interference about 700 metres from the finish of the race.   The drivers represented the connections of the horses involved.

Mr Holmes said Mr Jones attempted to move KIWI INGENUITY to three wide.   The movement was not rapid but Mr Jones’ cart wheel struck the hind leg of KIWI INGENUITY causing it to break.

Stipendiary Steward Mr J Muirhead demonstrated the incident by use of the video film.  He said Mr Jones had exposed his sulky wheel to the legs of KIWI INGENUITY.   Mr Jones said it was a gradual outward movement -  a safe push out and that KIWI INGENUITY had run up behind him and caused the contact.

The committee prefers the evidence of Mr Holmes and Mr Muirhead.   The outward movement to BADLANDS JEWEL caused the contact and thereby caused interference to the chance and progress of KIWI INGENUITY.   The video film confirms the evidence of Mr Holmes and Mr Muirhead.    Drivers are permitted to move outwards at that stage of the race but must do so with safety.    The protest is upheld.    BADLANDS JEWEL is relegated to immediately behind KIWI INGENUITY, the amended placings being:
