Facts:
An information instigating a protest was lodged by Mr S Argue driver of Horse 5 Dusky Sound placed 4th against Horse 8 Russian Ball (driver N Chilcott) placed first. It alleged that interference had been caused 300 metres after the start.
Both drivers appeared for the hearing with Miss Chilcott confirming she wished to challenge the protest.
Mr Argue referred to film footage to explain his perspective of the incident. He explained that he had come out of the start without any gate speed and was looking to slide with cover somewhere. He looked inside to see Mr Ferguson coming back and Miss Chilcott was coming down on him. He called two or three times for room. There was no room and she continued down on him quite violently. This caused his horse to gallop.
Miss Chilcott told the hearing there was a cart width inside Mr Argue as he was calling for room after he eased to the back of Mr Butcher.
She was entitled to ease him down providing there was clear space on his inside which there was. The Easing Down Regulations permitted this. She was clearly well in front of him and it was his obligation to move down. He had elected not to go down and had broken himself up.
The Stipendiary Stewards told the hearing that they did not support Mr Argue's contention. They did not believe that Miss Chilcott had breached Rule 869 and said that she had eased Mr Argue down as she was entitled to in a safe manner.
Mr Argue responded by saying he would have risked contacting Mr Ferguson had he not resisted Miss Chilcott.
