RACE NO.3 INFORMATION NO.13029 RULE NO. 870

--

An Information instigating a protest was lodged by Stipendiary Steward Mr T.W. TAUMANU following the running of Race 3. It alleged that Horse 2 EARL OF CAMBRIDGE (Driver T HERLIHY),placed second by the Judge, had broken and galloped for approximately 75 metres of the final 200 metres of the race

The Connections of the horse were represented by Trainer Ms M WALLIS and Driver Mr T HERLIHY who indicated they wished to contest the protest.

--

Immediately prior to the commencement of this race a power outage occurred in the district which closed down all facilities at the Race Course including the TAB Video coverage and the live race commentary. Subsequently there was no video footage of any part of the race available for review or inspection by the Stipendiary Stewards, the horse’s connections or the Judicial Committee

--

Stipendiary Steward Mr TAUMANU gave evidence of his observations from the Judges Box immediately above the finish line. He saw the horse driven by Mr Herlihy go off stride and being quickly restrained inside the last 200 metres of the race. He estimated the horse galloped for approximately 75 metres definitely well in excess of the 50 metres deemed to put the horse in breach of the Breaking Horse Regulations.He said that he believed the horse-had returned to it correct gait immediately before crossing the finish line.

Stipendiary Steward Mr J MUIRHEAD also gave evidence of his observations from the same position. He told the enquiry that the running rail had black marks every fifty metres prior to the finish line.

He saw EARL OF CAMBRIDGE break shortly after the mark one hundred metres from the finish line and continue galloping through to the finish line, being lapped on by Idle Mal (N Chilcott) and Footloose (P Scaife). He estimated the distance the horse galloped was between 70 and 80 metres and definitely in excess of 50 metres. After breaking, from leading the field, Earl of Cambridge lost ground to the eventual winner Painted Cloud (R Fensom)

Mr HERLIHY conceded that his horse had broken and he concentrated on getting the horse back into it proper stride. He had galloped and he was not sure of the distance but it didn’t feel as if he had galloped in excess of 50 metres. He disagreed with the distance as given by the Stipendiary stewards but it was only his opinion.

Ms WALLIS said she watched the race and didn’t feel the horse had galloped that far. She trains the horse and was solely watching him. She said that in the absence of camera footage it was difficult to identify exactly how far the horse had galloped.

The Stipendiary Stewards were satisfied that Earl of Cambridge had returned to its correct gait prior to the finish line and that therefore the lapped on rule did not apply.

Decision

The evidence given by the Stipendiary Stewards supported by their view of the race with reference to the 50 metre marks clearly shows that EARL OF CAMBRIDGE broke from it proper gait inside the final two hundred metres of the race for a distance in excess of 50 metres in breach of the Breaking Horses Regulation.

The evidence given by Mr Herlihy clearly showed he could not categorically argue with this evidence.

Ms Wallis also felt that horse had not galloped the distance but could not provide any support for this contention.

I am satisfied the Information lodging the protest has been properly brought and from the evidence find the protest has been upheld.

Horse 2 EARL OF CAMBRIDGE is disqualified and the judge’s placings are amended as follows
