--Trainer Mr H HABRAKEN was charged with presenting CHROMEAZONE in the assembly area without Pull down Blinds,
--the horse having previously raced with the same at the Taranaki Trotting Club Meeting on the 18th December 2005.
--Mr HARBRAKEN admitted the charge and appeared for the hearing
--Evidence was given by Mr VanKan and the charge was established.
--In mitigation Mr HARBRAKEN said that he had used the equipment at Taranaki on the 18th December 2005, but it had failed to properly deploy and he had been spoken to about this by Mr VanKan at the meeting.
--He had told him then that he would not be using the equipment again and although he had not notified the Secretary of the Racing Club within the prescribed time believed that his advice to Mr VanKan would suffice.
--Mr Van Kan confirmed the discussion with Mr Harbaken at Taranaki
--But submitted there had been a breach of the rule which Mr Harbaken had admitted.
--Following submissions on penalty Mr Harbraken was fined $100.00
