The protest is dismised and authority to pay dividends is authorised.

Facts:

An information instigating a protest was lodged by Stipendiary Steward Mr J Muirhead following race 5.  The protest on behalf of the connections of horse 8 Caesar’s Babe, placed 5th, against horse 1 Western Roll placed 4th alleged interference had occurred approximately 300 metres from home when Western Roll checked Caesar’s Babe causing it to lose momentum.
 
The judges placings were
1st 2 Westerly Wind
2nd 5 Rocket Venus
3rd 9 Dominique Prieur
4th 1 Western Roll
5th 8 Caesar’s Babe
6th 7 Norvic Flyer

Submissions for Decision:

Stipendiary Steward Mr Muirhead referred to video footage of the relevant stage of the race and identified Western Roll 3 deep on the running line followed by Dominique Prieur (M Kerr) in turn followed by Caesar’s Babe. Western Roll paced roughly broke for a stride and checked Mr Kerr who in turn checked Mr Ferguson causing his horse to lose momentum. The margin between Western Roll and Mr Ferguson on Caesar’s Babe was 2.1 lengths.
Mr Ferguson had nothing further to add. The horse ahead of him had come back on him which caused him to lose momentum.
Mr Abernathy explained that his horse had paced roughly for a stride on the last bend before running home for 4th. He had maintained his line.
Mr Fleming didn’t believe his horses actions had cost Caesar’s Babe more than two lengths. His horse had kept up on the third placed horse.

Reasons for Decision:

The Committee having listened to the evidence and examined the video footage was satisfied that Western Roll momentarily broke from its gait for a stride on the final turn. The horse immediately regained its pace and throughout maintained its line on the running rail. Dominique Prieur directly behind took hold as did Mr Ferguson on Caesar’s Babe.  The evasive action taken occurs regularly during the course of racing and it is the responsibility of drivers to remain vigilant.
 
The committee was satisfied that the actions of Western Roll or its driver did not cause interference sufficient to warrant any change in the Judges placings.
