An Information was lodged by Stipendiary Steward Mr TW Taumanu against horseman Mr PG Young alleging that as the Driver of PERIGO he failed to give his horse the full opportunity to win the Race or to obtain the best possible position and/or finishing place through his lack of vigor over the concluding stages of the Race.

An Information was lodged by Stipendiary Steward Mr TW Taumanu against horseman Mr PG Young alleging that as the Driver of PERIGO he failed to give his horse the full opportunity to win the Race or to obtain the best possible position and/or finishing place through his lack of vigor over the concluding stages of the Race.
 
Mr Young did not admit the breach and was present.
 
Rule 868(2) was read and it states “Every horseman shall take all reasonable and permissible measures at all times during the race to ensure that his horse is given full opportunity to win the race or to obtain the best possible position and/or finishing place.”
 
Mr Young requested an adjournment because it was a serious charge and he needed to seek advice and arrange his witnesses.
 
Mr Taumanu requested that the charge be amended to be pursuant to Rule 868(3) . He then requested that instead of the Amendment that there be an alternative charge under Rule 868(3) against Mr Young.
 
Rule 868(3) was read and it states” Every horseman shall drive his horse out to the end of the race if he has any reasonable chance of running first, second, third, fourth, fifth or sixth.”
 
Mr Young stated that he had finished 6th.
 
This Committee explained to Mr Young that the charges under each Rule were laid in the alternative and what the effect of charges being laid in the alternative meant for him.
 
Mr Young consented to the alternative charge and he does not admit either charge and has requested an adjournment because they are serious charges.
 
The Committee advised the Parties that in accord with JCA Policy the charges are adjourned sine die. A Hearing Date will be arranged by the Executive Officer of the JCA .
