An Information was lodged by Stipendiary Steward Mr TW Taumanu against Trainer Mr D Chandler alleging that a front hopple carrier on his horse MONTY CARLOS came adrift and this caused a false Start to Race 11.
 
Mr Chandler did not admit the Breach and was present.
 
Rule 864(2) (d) was read to Mr Chandler and it states “ Every horseman, owner, trainer and assistant thereof of a horse shall with regard to that horse ensure that all gear is correctly applied and/or affixed so as not to malfunction or come adrift
 
Mr Taumanu told this Committee that he received a call from the Starter advising that there was a false Start to Race 11 because a front hopple carrier had come adrift on MONTY CARLOS. The Starter told Mr Taumanu that the Driver of MONTY CARLOS had called out to him about the carrier strap coming adrift. The gear had not broken but rather had come adrift.

Mr Taumanu had checked the hopples and they were in good condition. He did say however that the carrier strap had come adrift and this had caused the false Start and had affected other horses in the Race.
 
Mr Chandler agreed with Mr Taumanu’s evidence and acknowledged that the hopple carrier coming adrift had caused the false Start.

Mr Chandler was asked by this Committee why he was contesting the charge when he agreed with the facts as presented by Mr Taumanu. He told this Committee that he had a previous charge under this Rule about 3 months ago with the same hopples and as a result of that was advised to tape up the carrier straps and he had done so and he believed he could not do any more but he readily acknowledged again that the facts as presented were correct and that the strap had come adrift. Mr Chandler showed the hopples to the Committee and they were in good condition. He also pointed out that they were a special type of hopples which had special buckles that were designed not to come undone. He agreed however that this had now happened twice.  Mr Chandler also told this Committee that his horse had a high pacing action and he needed the carrier straps to be on the last hole.

In answer to a question from this Committee he advised that MONTY CARLOS had raced 5 times in these hopples without incident since the first time that he was charged under this Rule.  Mr Chandler said he had no proper explanation for the carrier strap coming adrift this time. He said the hopples had been taped and he could only put it down to his horse’s high action.
 
This Committee finds the charge proven not only on the evidence put before it but also Mr Chandler’s admission during the Hearing.
 
The Parties were asked for submissions as to penalty. Mr Taumanu referred to the JCA Guidelines which provide for a fine of $250.00 and also to the fact that this was Mr Chandler’s second such offence in the last 3 months. Mr Taumanu also said that a false Start affects other horses in the Race. The Stipendiary Stewards requested a fine of $250.00.

Mr Chandler did not offer any submissions as to penalty.
 
DECISION
This Committee has taken into account the evidence presented to it as well as the submissions made by the Parties. The Committee accepts that a false Start could affect other horses in the Race and it is also concerned that gear coming adrift could present a safety issue. False Starts also cause disruptions to Club’s Programmes.  We are aware of the JCA Guidelines for this offence and we have taken into account that this is Mr Chandler’s 2nd offence of this type in 3 months. The first offence did not result in a false Start but this one has.
 
Having considered all matters before it this Committee imposes a fine of $250.00 on Mr Chandler.
