An Information was lodged by Stipendiary Steward Mr TW Taumanu against Trainer Mr A Grayling alleging that a front hopple carrier on his horse ACE OPERATIVE came adrift and this caused a false start to Race 10.

Mr Grayling admitted the breach but advised this Committee that he wished to be present at the Hearing.

--

 

--

Mr Taumanu told this Committee that he had a call from the Starter advising that there was a false start to Race 10 because the front hopple carrier on ACE OPERATIVE had come adrift.

--

Mr Grayling accepted Mr Taumanu’s evidence but he also produced to this Committee the hopples used on his horse. He advised that the hopples were virtually new and had only been used 3 times. Mr Grayling said that it was an offside buckle that had come undone and he did not know why. Mr Grayling said he had a good record in respect to gear and  he had no explanation for the carrier strap coming undone. He also confirmed that as the gear was new the carrier straps had not been taped.

In answer to a question from this Committee Mr Grayling acknowledged that gear coming adrift was a safety issue.

--

The breach having been admitted this Committee therefore finds the charge proven.

--

The parties were asked for submissions as to penalty.  Mr Taumanu referred to the JCA Guidelines which provide for a fine of $250.00 and that is what the Stipendiary Stewards were seeking. Mr Taumanu pointed out that a false Start had been caused and this affected the other horses in the Race.

--

Mr Grayling said that a fine of that amount was excessive and he pointed to the gear being new and to his good record. He also asked for consistency as far as a fine was concerned and he referred this Committee to a fine of $100.00 imposed several months ago at Cambridge for an admitted breach of this Rule.

DECISION

--

This Committee has taken into account the evidence before it as well as the submissions of the parties. The Committee accepts that a false Start would affect other horses in the Race and it also causes a delay to the Club’s Programme for the day. The Committee is also concerned that gear coming adrift is a safety issue and this was acknowledged by Mr Grayling.

We are aware of the JCA Guidelines for this charge but we have also taken into account Mr Grayling’s Guilty Plea as well as his good Record.

--

 

--

We also point out that this case is different to the Cambridge one that Mr Grayling referred to in that the previous case did not involve a false start being caused.

--

 

--

Taking all these matters into account this Committee imposes a fine of $200.00  on Mr Grayling.
