An Information was lodged by Stipendiary Steward Mt TW Taumanu against the second placing of THE WAY YOU KISSME on the grounds that it broke inside the last 50 metres of the Race and in particular broke 20 metres short of the Winning Post and was lapped on by the 3rd placed Horse Aubee and the 4th placed Horse Bossy Tart while it was in a break.

An Information was lodged by Stipendiary Steward Mt TW Taumanu against the second placing of THE WAY YOU KISSME on the grounds that it broke inside the last 50 metres of the Race and in particular broke 20 metres short of the Winning Post and was lapped on by the 3rd placed Horse Aubee and the 4th placed Horse Bossy Tart while it was in a break.
Present at the Hearing was Mr D E Kaa the Trainer and part Owner of THE WAY YOU KISSME.
Rule 870 (5) was read out to Mr Kaa and it states “ Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse or horses in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its gait as a result of interference to such horse or its horseman, then (subject to Rule 869(8) such relegation shall be at the discretion of the Judicial Committee “
Mr Kaa advised this Committee that he did not contest the Protest.
Mr Taumanu showed the Committee the video films of the finish and the films clearly showed THE WAY YOU KISSME breaking short of the Winning Post and not being in its correct gait at the finish.
The Protest not being contested is accordingly upheld and this Committee relegates THE WAY YOU KISSME from 2nd placing to 4th placing.
The amended placings are now :
(12) Millwood Miami - first
(4) Aubee - second
(7) Bossy Tart - third
(11) The Way You Kissme - fourth
(3) Rocket Venus - fifth
(9) Taffeta Bromac - sixth
