Mr Taumanu demonstrated the incident by use of the video film. CHAS LUNEY broke from its gait free of interference about 20 metres from the finishing line and was still galloping when its nose reached the finishing line. CHAS LUNEY was clearly lapped on by ON MY WAY – the official margin between the two horses was .3 of a length.

In accordance with the mandatory provisions of the rule, I relegate CHAS LUNEY to immediately behind ON MY WAY, the final placings then being :
