Under Rule 870 (5) an information instigating a protest was lodged by Stipendiary Steward Mr T Taumanu against CHAS LUNEY, driven by Mr G Smith, placed 4th by the Judge, on the grounds that the horse was not in its correct gait when its nose reached the finishing line and it was lapped on by ON MY WAY, driven by Mr A G Herlihy.

Mr Smith, representing the connections of CHAS LUNEY, endorsed the information “I do not contest protest”.  Mr Smith was present at the hearing.

Mr Taumanu demonstrated the incident by use of the video film.  CHAS LUNEY broke from its gait free of interference about 20 metres from the finishing line and was still galloping when its nose reached the finishing line.  CHAS LUNEY was clearly lapped on by ON MY WAY – the official margin between the two horses was .3 of a length.
