Mr McKendry admitted the breach and did not wish to be present at the Hearing.

Rule 857(7)(g) provides “no Horseman shall fail to come up into and/or maintain his position.”

Mr Taumanu demonstrated the incident by use of the video film and this clearly showed Billy Maguire back off the mobile barrier prior to the start and that horse did not move up into its position prior to the gate being released. The film also showed that Mr McKendry did not appear to be making any great efforts to get his horse up into position and he appeared to be driving conservatively.

Taking all matters into account I impose a fine of $250.00 on Mr McKendry.
