Following the running of Race 6, The Nevele R Fillies Heat 6, Stipendiary Steward Mr T W TAUMANU filed an information pursuant to Rule 1104 (1)(b) requesting a ruling as to whether the race be declared void as it was run over the distance of one mile instead of the programmed 1700 metres.

Rule 1104 states
----
An information in respect to any race may be filed on any of the following grounds
--(a)……….

(b) that the race was run over the wrong distance
----
(c) ……….
----

The Judicial Committee on determining the proceeding may declare the race to be void and may direct that it be run again

(3) Any decision of the Judicial Committee pursuant to this rule is
--declared to be final

Present for the hearing were Stipendiary Stewards Messrs Taumanu, Muirhead and Wallis, Registrar Mr R Death, Cambridge HRC Secretary (and race night Judge), Mr K A Wells.

Judges placings and authority for payment of dividends were suspended pending a decision on the ruling.
----
Stipendiary Steward Mr Taumanu explained to the hearing that Race 6 on the card was run over the incorrect distance.
----
According to the official race card printed the race was shown as being over a distance of one mile. The Harness Racing Weekly official programme confirmed the correct distance was over 1700 metres.
----
The on course TAB Manager confirmed their listing for the race indicated the distance was over 1700 metres.
----
Video footage of the race was played to the hearing that established the race had been run over an incorrect distance of approximately 1600 metres.
----
The race night starter Mr C COURTNEY confirmed that he had started the race over one mile as listed in the race card for the meeting. He had no other instructions for the starting of the race and was not aware the race distance had been wrongly declared in the race book.
----
Club Secretary Mr Wells confirmed the race book had listed the race distance incorrectly which had not been picked up after return from the printers.
----
The race with a stake of $18000.00 was run with a field of 9 horses. The Judges placings were

1st 2 LANCOME trainers PURDON/ PAYNE
--2nd 7 DE LOVELY SMALL
--3rd 6 KUSADASI PURDON/PAYNE
--4th 5 FLYING POCKETLANDS REID/ROGERSON
--5th 1 SLOANE SQUARE SMALL
--6th 4 JILLETTO MITCHELL
--7th 9 SIXPENCE REID/ROGERSON
--8th 8 INDULGE SMALL
--9th 3 MADAM MAYOR HABRAKEN

The trainers of the various horses were sought for the hearing. Messrs Mitchell and Harbraken appeared for the committee and confirmed that their horses had not been disadvantaged through the incorrect distance run.

Messrs Reid and Purdon had left the track and following instruction were contacted by Registrar Mr Death by cell phone.
--Both confirmed their horses had not been disadvantaged.
----
Mr Small was also contacted still on the course but unavailable to attend the hearing. He was unable to readily confirm or otherwise that his horses had been disadvantaged.
----
The Stipendiary Stewards were of the opinion there was no disadvantage to any of the runners because of the marginally shorter distance run.

DECISION.

The Committee considered the Request for a Ruling and in arriving at the decision took particular cognisance of the following matters.
----
The TAB confirmed their listing for the race indicated to the off course viewers that race was over 1700 metres in accordance with the Harness Racing Weekly conditions of the race. This race for a stake of $18000.00, was one of a series of heats
----
The race was listed in the Cambridge Harness Racing Club race card as being over a distance of one mile and was started and run accordingly. This error was not detected by race night officials until after the race was run
----
The oncourse public was not disadvantaged as the race was run over the distance described on the race card.
----
The Trainers of all horses entered to race had no adverse comments regarding any negative impact of the race being over a shorter distance. The type of race had not changed.
----
Stipendiary Stewards supported this contention

The films also satisfied the committee that no runner was disadvantaged. We are further satisfied that the best interests were served by us exercising our discretion to allow the race to stand
----
Accordingly we confirm the Judges preliminary placings will stand and that dividend and Stake payments be authorised.
