An Information was lodged by Stipendiary Stewards Mr TW Taumanu and Mr JM Muirhead against Horseman Mr W Taylor alleging that Mr Taylor drove Earleen Castleton carelessly when racing into the first bend forcing Partyandgetlucky (Driver D Branch) down onto Ice T (Driver R Brosnan) causing Partyandgetlucky to break.

Mr Taylor admitted the breach and was present at the Hearing.

Rule 869(3)(b) states “No Horseman in any race shall drive carelessly.”

Mr Muirhead gave evidence by use of the video film and showed the movement of Mr Taylor’s horse down onto Partyandgetlucky and then in turn onto Ice T.   This caused Partyandgetlucky to break and also in attempting to salvage the situation Mr Taylor’s own horse broke.

Mr Taylor acknowledged his mistake and acknowledged that he had caused the interference to the other two horses.

In regard to penalty Mr Muirhead pointed out that Mr Taylor had a good record although he does not drive a lot and he suggested a suspension of Mr Taylor’s license for a period of two weeks.

Mr Taylor accepted that a suspension of his license was appropriate.

--

In deciding on penalty I initially took the view that the incident warranted a suspension of Mr Taylor’s license for more than the two week period.   I do however take into account his guilty plea and his acknowledgement of his error, I also take into account his driving record.

I accordingly suspend Mr Taylor’s Horseman’s License up to and including the 11th of July 2008.
