The charge having been admitted is accordingly proved.

Penalty:

The Committee orders that Mr Brownlee’s Horseman’s Licence be suspended up to and including the 23rd of September 2011. That is five Race Meetings.

Careless driving.

Facts:

Following the running of Race 9, an Information was lodged by Stipendiary Stewart Mr TW Taumanu against Driver Mr IJ Brownlee alleging a breach of Rule 869(3)(b) in that with approximately 1700 metres left to run, Mr Brownlee the Driver of UP N OFF drove carelessly causing interference to WICHITA which broke and then caused resulting interference to DOMINIQUE PRIEUR and INCUBUS.

Mr Brownlee was present at the Hearing and indicated that he did admit the breach.

Rule 869(3)(b) provides:

No Horseman in any race shall drive carelessly.”

Submissions for Decision:

Mr Brownlee accepted the evidence that had been presented in the Protest Hearing.

Submissions for Penalty:

Mr Taumanu said that this matter was at the upper end of the scale. It continued on for a period of time and in his submission it warranted a suspension of Mr Brownlee’s Horseman’s Licence for a month.

Mr Brownlee for his part said that he did have horses starting over the next few weeks and that he had four in next week at Auckland and he was happy to pay a fine.

Reasons for Penalty:

The Committee has looked at the films a number of occasions and Mr Brownlee continued on with the movement over some distance when clearly he would have known he was squeezing Mr Butcher up for room. The Committee believes that this is an incident at the upper end of the scale.

The Committee believes that the appropriate penalty is suspension of Mr Brownlee’s Horseman’s Licence.
