Facts:
Following the running of Race 9 an Information Instigating a Protest was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of horse number 4 UP N OFF on the grounds of moving inwards with approximately 1700 metres to run causing interference to horse number 1 WICHITA with a resulting interference to horse number 9 DOMINIQUE PRIEUR and horse number 3 INCUBUS.
The Protest was contested.
Submissions for Decision:
Stipendiary Steward Mr JM Muirhead on behalf of Mr Taumanu demonstrated the incident by use of the video films and this showed that with approximately 1700 metres to run the field was leaving the front straight. WICHITA was in front on the inside with Mr Brownlee and UP N OFF coming around on the outside. Mr Brownlee continued to move in and this resulted in WITCHITA running over several pylons and ultimately breaking and as a result causing interference to DOMINIQUE PRIEUR and INCUBUS.
Mr Butcher said that it was tight racing around the bend and that he did run over four pylons as a result of Mr Brownlee running inwards.
Mr Abernethy said that he simply ran out of room as a result of the interference in front of him.
Mr Brownlee said that he was on the apex of the bend and he was entitled to his running line and he tried to suggest that Mr Butcher pushed up inside him.
Mr Judson said that Mr Abernethy hit pylons.
Mr Butcher confirmed to the Committee that he simply ran out of room.
Mr Taumanu by way of summary said that Mr Brownlee never cleared Mr Butcher and squeezed him for room and caused the interference. He said that Mr Butcher was entitled to hold his position.
Reasons for Decision:
The films quite clearly showed the movement of the horses concerned and showed Mr Brownlee continually moving in as the horses went around the bend at about the 1700 metre mark. The films clearly showed the interference caused to Mr Butcher’s horse.
