The protest is upheld and number 2 BAZZA’S CHOICE is relegated from second place to behind horse number 7 APACHE CHIEF.

The amended result is now:

1st 5 – Mahogany
2nd 4 – Anvil on the Sly
3rd 8 – Stepin Fetchit
4th 1 - Lakadema
5th 3 – Mister T
6th 11 – Navy Seal

It was ordered that dividends and stakes be paid in accordance with the amended result.

Facts:

Following the running of Race 3 an Information Instigating a Protest was lodged by Stipendiary Steward Mr TW Taumanu against the third placing of horse number 2 BAZZA’S CHOICE on the grounds of causing interference on the run home to horse number 11 NAVY SEAL and horse number 7 APACHE CHIEF.

The Protest was contested.

Submissions for Decision:

Mr Taumanu demonstrated the incident by use of the video films and this showed that after the horses turned into the straight BAZZA’S CHOICE driven by Mr Butcher ran outwards causing interference to NAVY SEAL driven by Mr Herlihy with resulting interference to APACHE CHIEF driven by Mr Mitchell.

Mr Butcher said that his horse had overreacted as a result of movement from the inside and that he had tried to straighten it up and that he had only just brushed the leg of Mr Herlihy’s horse.

Mr Herlihy said that his horse had hung out and wasn’t going that good.

Mr Mitchell said that his horse was running home alright and that as a result of the outwards movement of the other two horses he lost his momentum and his chance.

Mr Taumanu in summary said that it was clear that interference had taken place, that it was caused by BAZZA’S CHOICE and that as a result it should be relegated to behind APACHE CHIEF.

Reasons for Decision:

The Committee viewed the films and listened to the evidence. The films are very clear and the Committee is of the view that the chances, particularly of Mr Mitchell’s horse, were affected. This was caused by BAZZA’S CHOICE.
